Loudly Proclaim A Very Big Deal

OK, I can't resist, so let's start off with: "Hear ye, hear ye! President Joe Biden has successfully gotten rid of an outdated and unnecessary rule, which will save millions of people thousands of dollars each." How's that for some good news to start the week? From now on, anyone will be able to walk into a drug store and buy a hearing aid over the counter. No doctor's appointment or prescription will be required.

This was an outdated rule that was no longer necessary. It added enormous costs (both in money and in time and effort) to the process of improving one's hearing. Perhaps back when the devices were analog and not very advanced, there was a reason for a professional to adjust and care for hearing aids, but these days the technology is a lot better and a lot cheaper. So there was no real need for the rule to continue, for most of the people who are hard of hearing. An off-the-shelf hearing aid is really all that most people will ever need. And now they'll be able to buy one for as little as perhaps $200 (the first company to announce a new product is going to sell it for $799, but there will be a lot of competition for this market very soon). The Food and Drug Administration estimates that this will save people an average of $3,000 -- which is a big savings, obviously. Some models of hearing aid sell for as much as $5,500 (or even more with added audiological services, which I am tempted to call "bells and whistles" for obvious reasons...). But now they'll all be subject to the power of the marketplace and they'll have to compete against each other on price. That is a big difference and it should be celebrated.

Full disclosure: I personally have not (yet) needed a hearing aid in my life, but it's entirely possible that I will at some point. This is the result of blasting a lot of loud rock music over headphones at an early age, and I will pay the price for this youthful exuberance for the rest of my life. So while not yet a customer, the subject still interests me.

When (or hopefully "if") I get to that stage, I am going to appreciate the fact that I don't have to get a prescription for a basic electronic device. Up until a few politicians pointed it out (in an effort to get the rule overturned) a few years back, I had no idea that prescriptions actually were necessary for hearing aids. It was rather surprising to learn, since the obvious reaction is: "Why?" But now it is not necessary anymore, which is a rare instance of politicians bringing some sanity to federal regulations.

Basic health aids should not require a visit to a doctor. If a person needs reading glasses, they do have the option of seeing an eye doctor and getting a perfect prescription, but they also have the option of just trying some generic off-the-shelf reading glasses in a drug store, and buying the ones that work "close enough" to perfect for them. These are priced incredibly cheaply, as opposed to the hundreds of dollars you'd likely spend getting prescription frames and lenses. Both options exist, and nobody is forced to use the expensive route if they don't want to or feel they need to.

Now hearing aids will be available in a similar way. People will be able to go down to their local drug store or big-box store, find out which one works adequately enough for them, and buy it for a fraction of what they'd have to pay in a doctor's office. And since most health insurance plans don't actually cover hearing (the same bizarre way they don't cover eyes or teeth), the difference in price used to come directly out of patients' pockets. This is a big change, in other words.

This change has been a long time coming, but it was Joe Biden who got it over the finish line:

The final rule is a victory for President Joe Biden's administration, which pushed the FDA to finalize the rule as part of its efforts to renew antitrust enforcement.

"Right now, if you need a hearing aid, you can't just walk into a pharmacy and pick one up over the counter," Biden said when unveiling an executive order on antitrust enforcement in July 2021 that includes instructions to finalize the rule. "You have to get it from a doctor or a specialist. Not only does that make getting hearing aids inconvenient, it makes them considerably more expensive, and it makes it harder for new companies to compete, innovate, and sell hearing aids at lower prices."

It's also a win for Sens. Elizabeth Warren (D-Mass.) and Chuck Grassley (R-Iowa), who wrote the original 2017 legislation ordering the FDA to allow over-the-counter sales. While former President Donald Trump signed their bill into law, his administration never finalized the process.

Democrats should tout this as a big political success while campaigning. It's one of those things that only impacts a limited amount of people (there are an estimated 30 million Americans with hearing issues, but only a fraction of them get hearing aids, at least up until now), but for those people the impact will be an enormous help. Instead of paying the price of a half-decent used car to get hearing aids, people can now buy them for only a few hundred dollars -- a huge bargain! The issue is also fairly tailor-made for politics, since the biggest group of people affected (seniors) is also the demographic that votes at a very high rate. And it's pretty easy to make this point (as loudly as necessary):

"Thanks to Joe Biden, the F.D.A. has now removed the need for a prescription from hearing aids. You can now just walk into a pharmacy and pick one up! No doctors' appointment, no prescription, no hassle. And this is going to save people thousands of dollars of unnecessary cost. Anyone who doesn't think this is a big deal should ask one of the millions of Americans who could use a hearing aid -- they'll tell you what a big deal this is! Democrats are working hard to bring down medical care costs in all sorts of ways, and I'd like to thank Joe Biden for achieving this one."

    Great news and long overdue considering advances in modern technology and how cheap it has been for quite a while to manufacture tiny microphones, receivers, and amplifiers.

    Good on Biden for the implementing of federal rules that allow Americans to altogether bypass state laws. :)

    Full disclosure: I personally don't need them (yet) either, but I've definitely bought dozens of pairs of them for veterans who lost their hearing as a result of also "blasting," and I can now buy whole lot more. :)
