Biden Should Have Fired Eric Lander

President Joe Biden missed an opportunity to make good on a campaign promise this week. It's not the most significant thing happening in the White House right now, I will admit, but it was a missed opportunity nonetheless. Biden could have stood strongly (as he had pledged to do) for the rights of people working for him not to be bullied while doing their jobs. Instead, he wound up looking detached and weak. Perhaps this was the fault of overzealous aides who did their best to not allow a controversy to actually enter the Oval Office, but there's also a danger in protecting the president too much from having to make hard choices.

The story starts with Politico, who was researching an article exposing Dr. Eric Lander, Biden's cabinet-level chief science advisor, as being a bad boss. Plenty of evidence of this exists, apparently, as he would routinely berate and belittle people working for him -- women, in particular. Although Lander is seen as somewhat of a technological wunderkind in the medical research area, that doesn't always equate to being a good boss. Or even one that doesn't break workplace rules, for that matter.

After it was revealed that there had been an internal investigation into Lander that did indeed find evidence of Lander mistreating underlings, the White House's initial response was beyond weak. It recommended that Lander do some touchy-feely events with his staff (brown-bag lunches'll fix everything!) and that the whole department (but not Lander himself) undergo workplace sensitivity training.

Politico had the whole story:

The two-month investigation found "credible evidence" that [Dr. Eric] Lander -- a Cabinet member and director of the Office of Science and Technology Policy who the White House touts as a key player in the pandemic response -- was "bullying" toward his then-general counsel, Rachel Wallace, according to a recorded January briefing on the investigation's findings.

Christian Peele, the White House's deputy director of management and administration for personnel, said that the investigation also concluded that there was "credible evidence of disrespectful interactions with staff by Dr. Lander and OSTP leadership," according to the roughly 20-minute briefing, which included a representative of the White House Counsel's office.

There was also "credible evidence" that Lander had spoken "harshly and disrespectfully to colleagues in front of other colleagues," Peele said, according to the recording. "The investigation found credible evidence of instances of multiple women having complained to other staff about negative interactions with Dr. Lander, where he spoke to them in a demeaning or abrasive way in front of other staff," Peele said in the recording.

Wallace told Politico that Lander "retaliated against staff for speaking out and asking questions by calling them names, disparaging them, embarrassing them in front of their peers, laughing at them, shunning them, taking away their duties, and replacing them or driving them out of the agency. Numerous women have been left in tears, traumatized, and feeling vulnerable and isolated."

Here is what was originally proposed by the White House as an appropriate response to the problem:

As discipline, the White House required Lander to hold more collaborative meetings with subordinates, such as "brown bag sessions," Peele said in the recorded briefing. It also mandated more trainings for all staff on the workplace policy. Peele said in the briefing there would be a check-in at the 30 to 45 day mark to see if the problematic behavior has ceased.

Eight current and former staffers said Lander should have faced tougher consequences such as mandated training for himself specifically or a suspension. Some said he should be fired, given the president's stated zero-tolerance policy.

When entering office, Joe Biden made what sounded like a pretty iron-clad promise not to tolerate such behavior. "Zero-tolerance" is an entirely appropriate term for it, in fact:

[Dr. Eric] Lander's resignation came after the White House struggled throughout the day to explain why he had not quit or been fired, and how that squared with a pledge Biden made on his first day in office. On that day, he told staffers at swearing-in ceremony, "If you are ever working with me and I hear you treat another colleague with disrespect, talk down to someone, I promise you I will fire you on the spot. On the spot -- no if, ands or buts."

It's hard to square that with suggesting brown-bag lunches as a solution, really. Some Biden defenders were having fun yesterday parsing that statement within an inch of its life: "working with me" meant he'd have had to have been in the same room as Biden when it happened, and "I hear you" reinforces that, because Biden would have had to have personally heard such behavior himself in order to make good on his pledge. This is nonsense. It is a voyage into the weeds of weasel words and wriggling out of a clear promise. We all know exactly what Biden meant, and when put to the test with a very high-level instance, Biden didn't make good on his promise.

There could be a personal reason for this, as Politico pointed out:

[Dr. Lander] is a close confidante of the president. He served on the board of the Biden Cancer Initiative, the charitable organization the president launched after serving in the Obama administration. He became the first OSTP director in history to be granted Cabinet rank and is heading up the president's "Cancer Moonshot" initiative, a personal priority for Biden after the death of his son, Beau in 2015.

This certainly smacks of favoritism. Which is exactly what Biden's strong pledge was supposed to be against.

Obviously, someone at the White House realized yesterday that the situation had become politically untenable. Landers had to go. So they allowed him to resign. This, however, did nothing short of compounding the error. Biden promised: "I promise you I will fire you on the spot. On the spot -- no if, ands or buts." Not: "I will allow you to gracefully resign a few days later, after it all blows up into a political firestorm."

I for one would like to see some follow-up reporting on just exactly how involved President Biden was with this entire fiasco. Was the whole thing largely kept off his desk, handled by lower-level staff? Was Biden just not aware of what was going on and how bad the political optics looked for him? Or did Biden more directly break his pledge and try to sweep the whole thing under the carpet with brown-bag lunches, because the guy was such a close friend? That, obviously, would be much worse.

The whole episode is likely to be seen as nothing more than a tempest in a teapot, at least by the media at large. "It was just one guy, he's gone now, so what's the big deal?" in other words. The White House would probably dearly love for that to be the case.

But no matter how much interest is paid to this event, it still represents a rather large missed political opportunity. Lander should not have been allowed to resign. He should have been fired. Publicly. Biden himself should have announced this, and rededicated himself to that iron-clad pledge, in a clear message of support for the entire executive branch workforce: "When I said you will be fired, I meant what I said, and when I said 'No ifs, ands, or buts' I meant that too. Anyone disrespecting fellow employees in this manner will be fired, period." A simple statement like that would have reinforced Biden as a straight-talking guy and a man whose word is his bond.

Instead, Lander was allowed to slink off into the night with a resignation. Biden is apparently going to remain aloof from the entire mess. This sends entirely the wrong signal, both to executive branch staff ("he didn't really mean it") and the country at large ("Biden can't be trusted to keep his word"). Instead of chalking up a clear political advantage, Biden instead suffered a clear political black eye. And that is why Eric Lander should have been personally fired by President Biden.

    On Nov. 24, my colleague at RealClearInvestigations, Aaron Maté, wrote a detailed article highlighting a series of stories published by the New York Times and the Washington Post that contained “false or misleading claims.” The pieces he analyzed were either part of the entry the papers submitted to win a 2018 Pulitzer Prize for their Russiagate coverage or were written by reporters who shared in that honor. Significantly, the major errors and misleading assertions identified by Maté were not based on newly discovered information, but on documents and statements long in the public domain.

    Before publication, Maté sent multiple detailed requests for comment to the reporters and newspaper representatives. All but one of his queries went unanswered.     It's not surprising that in issues where children are the focal point... Democrats lose and lose bigly...

    With notable exceptions (our own JL) it's likely no one here is a parent..

    As such, Democrats simply don't understand why you don't want to piss off the American Parent..

    American Parents go from placid and easy-going to SCORCHED EARTH when it comes to their children..

    Children are easily THE issue for American parents.. Being protective of their children is one of the very few issues that cross ideological lines..

    That is why Democrat Parents (those that exist) and Republican Parents and Independent Parents come together on this issue..

    The issue of protecting our children is an issue that transcends politics..

    Florida Senate committee passes "Don't Say Gay" bill that would bar LGBTQ discussions in schools

    The Florida Senate Education Committee passed a controversial bill on Tuesday that would bar school districts from encouraging classroom discussion about sexual orientation or gender identity. The Parental Rights in Education bill, commonly referred to the "Don't Say Gay" bill by its critics, would apply to such topics in primary grade levels, as well as in cases where the discussions are deemed "not age-appropriate."

    The bill, proposed by Republican State Senator Dennis Baxley, would extend to student support services, including counseling, and would require school district personnel to give parents all information related to a student's "mental, emotional or physical health or well-being," unless it's believed that such disclosure would result in abuse. Parents would be able to sue districts that do not follow these requirements.

    The bill's purpose, according to its text, is to "reinforce the fundamental right of parents to make decisions regarding the upbringing and control of their children."

    Teachers and counselors are supposed to PROTECT children from this kind of abuse..
