Friday Talking Points -- Republicans In Disarray!

Did what happened at the United States Capitol on January 6th, 2021 constitute "legitimate political discourse" or not? That was the question that has divided the Republican Party all week, and may serve to be the one memorable phrase that sums up the difference between those in the GOP who have completely surrendered all their morals and thought processes and attachment to reality to Donald Trump -- and those who have not. Because that's what it all boils down to, really.

Was January 6th a bunch of harmless tourists wandering through the Capitol in search of legitimate political discourse with their elected officials, or was it a violent insurrection perpetrated by a terrorist mob chanting "Hang Mike Pence!" who were intent on stopping the constitutional transfer of power between presidencies? The answer's pretty obvious, one would think, but apparently not -- not over in Republicanland, at least.

The raging debate over January 6th, what to call it, whether to condemn it, and whether it should be investigated as the worst crime against the U.S. Capitol since the War of 1812 was all succinctly summed up by the "legitimate political discourse" phrase, since it was deployed in a censure against two Republican House members who actually had the temerity to make good on their oath of office to "support and defend the Constitution of the United States against all enemies, foreign and domestic." A violent attack on the Capitol while Congress was attempting to certify the winner of a presidential election would certainly seem to qualify as something to be defended against, since the insurrectionist mob was so obviously comprised of domestic enemies of the Constitution.

Most Republicans, however, either don't believe this or are not willing to publicly state it anymore. They used to be a lot more willing to admit the truth, in the days immediately following the attack, but then their Dear Leader expressed his displeasure -- so by now most of them are quite willing to go along with his growing obsession over the 2020 election. Donald Trump has always had only one real litmus test and it's been pretty easy to understand all along: you are either with him wholeheartedly, or you are the scum of the Earth. There is no room for nuance, as with most Trumpian things. Because he still wields such enormous power with the Republican base, the politicians feel they have to support his increasingly-unhinged claims and let him rant and rave all he wants.

But the censure of Representatives Liz Cheney and Adam Kinzinger brought it all out into the open, because all of a sudden the media had a very succinct way to ask Republicans whether they had surrendered their ability to perceive reality to Donald Trump, or whether they would admit what every American saw with his or her own eyes that day. "Do you believe the mob who stormed the Capitol was engaged in 'legitimate political discourse' or not?" That's a pretty easy way to ask the core question. We certainly hope the pundits won't soon forget this poignant question, and will repeatedly ask it of each and every GOP politician they interview, from now on.

Of course, there are a handful who do not subscribe to this rewriting of history. HuffPost helpfully listed them all (to date):

Maryland's Republican Gov. Larry Hogan grieved on Twitter: "It's a sad day for my party -- and the country -- when you're punished just for expressing your beliefs, standing on principle, and refusing to tell blatant lies."

Sen. Ben Sasse (R-Neb.) said in a statement that Jan. 6 "was not 'legitimate political discourse' and I'll say it again: It was shameful mob violence to disrupt a constitutionally-mandated meeting of Congress to affirm the peaceful transfer of power."

Sen. Bill Cassidy (R-La.) was confounded by the censure. "The RNC is censuring Liz Cheney and Adam Kinzinger because they are trying to find out what happened on January 6th -- HUH?"

Sen. Mitt Romney (R-Utah) pounced on his party early and hard.

"Shame falls on a party that would censure persons of conscience, who seek truth in the face of vitriol," he tweeted Friday. "Honor attaches to Liz Cheney and Adam Kinzinger for seeking truth even when doing so comes at great personal cost."

"More important than who wins an election is that we have elections -- and that we have democracies," Romney said in an interview. "As authoritarian regimes around the world continue to gain ground, the United States cannot falter on principles of truth in our elections," he tweeted.

And, so far, that's about it from the Republican side of the aisle.

Romney was later quoted saying: "Anything that my party does that comes across as being stupid is not going to help us." Well, these days that's actually debatable, Mitt.

Since then, there have been a few others. Senate Minority Leader Mitch McConnell was the most plain-spoken of these: "We saw it happen. It was a violent insurrection for the purpose of trying to prevent the peaceful transfer of power after a legitimately certified election, from one administration to the next. That's what it was."

House Minority Leader Kevin McCarthy initially (and literally) fled from a reporter asking him the question this week, but later grudgingly admitted the truth -- well, with a jaw-dropping lie that is itself completely divorced from reality. When asked whether he agreed that the events of January 6th was (as McConnell had said) "a violent insurrection," McCarthy answered: "No one would disagree with that." He might want to check with Donald Trump -- as well as a large part of his party's base -- before being so dismissive of that particular idea.

Liz Cheney had the best response to McCarthy's answer: "It won't surprise anybody that the truth is not Leader McCarthy's strong suit. Leader McCarthy has been among those leading the effort to prevent any investigation of the attack and try to embrace former President Trump and whitewash what happened."

Michael Gerson, who used to be head speechwriter for George W. Bush, had probably the best-worded response (to what he called "the ritual censure of the sane") to the censure's fuller statement which condemned: "[the] persecution of ordinary citizens engaged in legitimate political discourse."

This seemed to imply that the violent shock troops of an anti-constitutional coup attempt carried a truer version of democratic ideals than the legislators investigating them. Support for seditious acts is now a normal and accepted element of Republican identity.

But then, being a professional speechwriter, you'd expect this level of erudition from Gerson. At the other end of the scale, the award for the weaselliest words of the week go to Senator Cynthia Lummis from Wyoming, who commented on the dispute over whether the Republican National Committee should have issued the censure or not: "I think it was an interesting approach to have a novel approach to have a national Republican committee take a position like that. So, this -- not a support or oppose -- this is just an observation that I thought that was novel and unique." MSNBC's Chris Hayes, upon hearing this, remarked: "Honestly, that is an all-time, great, cowardly politician quote. I have seen more than a few in my day, and that is up there." We have to say we agree.

The phrase "legitimate political discourse" will be remembered for a long time to come. In fact (ironically enough) it has now entered the American political lexicon, meaning henceforth the phrase itself will be... well... the subject of much legitimate political discourse. The censure and the origin of the phrase might not be remembered so well, but the phrase is destined to live on.

The real question is whether the split in the Republican Party will grow even wider and perhaps a little more balanced, if more Republican politicians start to realize this monomania about a fictional past (Trump's election obsession) is not going to help them win back suburban voters in general elections. For now, it's pretty lopsided towards the "whatever Trump says is reality, now and forever, unless of course he changes his mind later" side of the abyss.

Trump himself was rather boxed in this week, after multiple questions arose over his handling of presidential records. We already knew he had the habit of tearing up documents when he was finished with them, then throwing the pieces on the floor or (if his aides were lucky) in the trashcan. This is either evidence of behavior worthy of a toddler or of a mob boss worried about evidence, take your choice. But what we didn't know is that he would occasionally eat the shreds of paper or flush them down the toilet, repeatedly clogging up the White House "throne" Trump used. Maybe they should install that in the Trump Presidential Library, since it was also where he pretty obviously composed some of his most memorable tweets (in fact, we cannot think of a more poignant symbol of his entire time in office than displaying a presidential toilet to the public). But the big news was that when Trump finally slunk out of the White House for the last time (hopefully, at any rate), he absconded with at least 15 boxes of documents he wasn't legally entitled to take. Including (reportedly) not only the "love letters" Kim Jong Un sent him but also the map at the heart of Sharpiegate. Oh, and a bunch of papers marked "Top Secret," as well as other classified documents, too. At this point, the National Archives has referred the matter to the Department of Justice for possible prosecution of crimes. So that's how Trump's week went.

Here's a sentiment we can agree with, to sum it all up: "People who have nothing to hide don't... destroy evidence to keep it from being publicly archived as required under federal law." Those words were spoken by Donald Trump himself, on the campaign trail in 2016. Of course, he was talking about Hillary Clinton's emails at the time -- which makes it all the more curious how little Republicans seem to care these days about destroying evidence on such a widespread scale. Most of them, at any rate. Michael Steele (who used to chair the same Republican National Committee that just censured Cheney and Kinzinger) was one who rather amusingly did make this connection, while talking with MSNBC's Joy Reid:

During a discussion on Trump's removal of presidential records from the White House and his reported putting of sensitive papers into his mouth or down the toilet, Steele shoved a piece of paper into his own mouth and jokingly told Reid: "Yummy, yummy, pass the salt please."

It was just the latest example of Trump's flippant disregard for security, said Steele, who called out Trump and his allies who continue to criticize 2016 Democratic rival Hillary Clinton for using a private email account for government business when she was secretary of state.

"As for Hillary Clinton and her emails, I don't want to hear another word, not a damn word, from anybody, talking about Hillary Clinton and national security and her server," said Steele. "After this son of a you-know-who is sitting up there eating documents, please!"

Now there's a Republican who hasn't lost all touch with reality!

Speaking of reality, let's quickly whip through everything else that's been going on this week before we push on to the awards.

The monthly inflation number was released and it was even worse than expected -- the worst annual inflation in 40 years, in fact. That's not good news for Biden, although there is still time for him to recover from this before the midterms if it does finally start to ebb.

The growing border blockade up north is threatening to impact both the American and Canadian economies, and it could soon sprout a copycat trucker convoy here at home. Some are even wondering if the Super Bowl will see the start of a nationwide convoy of disgruntled truckers, so that'll be interesting to see on Sunday.

Ukraine is still under serious threat of Russian invasion, but perhaps Vladimir Putin is waiting until at least after the Olympics are over to make his move. Stay tuned....

Democratic governors, reacting to the rapid change in the pandemic situation, are announcing the end of mask mandates in blue states. It's worth noting that such mask mandates have not existed in most red states for a very long while now -- a detail the mainstream media is refusing to point out in all their breathless "reporting" on the issue.

In a story that really should have gotten a lot more attention, a company that contracts with the I.R.S. (and multiple other federal agencies) has decided to end the practice of requiring a "selfie video" to authenticate people signing up for government information (like the status of your taxes) through the use of facial-recognition technology. This is a horrendously bad idea, so it's welcome news indeed that at the first hint of bad publicity some saner heads decided it was not the way to go.

And, rather bizarrely, the White House had to nip their own fledgling scandal in the bud this week by affirmatively vowing not to use taxpayer money to buy crack pipes -- a charge baselessly made by a right-wing media outlet that was immediately picked up to stoke fake outrage among Republicans. An official statement was issued forswearing the use of taxpayer money to buy crack pipes, which headed the entire problem off at the pass.

 

Most Impressive Democrat Of The Week

We have two Honorable Mention awards to hand out before we get to the main event this week. The first one goes to groups of "suburban moms" who are increasingly banding together to have their voices heard in all the skirmishing over school boards and curriculum and book-banning and all the rest of the nonsense coming from the other side of the aisle. As the Washington Post explains:

Katie Paris, the founder of Red Wine and Blue -- a national network of like-minded, mostly Democratic suburban women -- believes the only way to fight back is to present a calm face to counter the angry groups that have dominated and disrupted board meetings and in some cases threatened officials. Her network of more than 300,000 women recently broadened its focus to fight the rising number of book bans across the country, launching a case tracker on Jan. 31, and is running training sessions to help women testify and manage highly charged government meetings.

"We believe it's time to get off defense," Paris said. "Why should we be the ones explaining ourselves? This is not why we moved to the suburbs. We moved to the suburbs for high-quality schools."

More power to them!

The second Honorable Mention goes to a Democratic candidate for Senate from Louisiana. Gary Chambers was first noted in these pages for a political ad where he sits and calmly smokes some marijuana while his own voiceover explains why he is strongly for legalization. His new ad is just as powerful and takes on voting rights and how Black voters are facing increasing hurdles to having their voices heard. While he is explaining all of this, Chambers pins to a clothesline, soaks with gasoline, and then burns a Confederate battle flag.

We truly wish Chambers success, because he is obviously a messaging genius, and the Democrats would really benefit from someone with these skills sitting in the United States Senate.

But this week's Most Impressive Democrat Of The Week award goes to Senator Jon Ossoff and Representative Abigail Spanberger, for taking the lead on the effort to ban individual stock ownership and trading by sitting members of Congress. Ossoff won his Senate seat in Georgia at least in part by hammering Senator David Perdue for his 2,500 stock trades while he was in Congress. It was an effective issue, and Ossoff and other Democrats are now following through with proposed legislation to ban the practice entirely. Abigail Spanberger has already been fighting this fight in the last session of the House, and together they are trying to form a bipartisan group with enough votes to move the measure through both houses of Congress.

Chuck Schumer appears to be on board with this effort, and this week Nancy Pelosi rather reluctantly came around as well (we wrote about her reluctance earlier in the week). This is an idea whose time has come, and the rank and file are driving it.

It really is a pretty obvious conflict of interest for sitting legislators to be able to trade stocks on whatever information they come across in the performance of their duties. Insider trading on such information is theoretically supposed to be illegal, but this rule is rarely enforced at all. The only real way to fix the obvious ethical problem is to just ban the practice entirely -- by requiring that any member of Congress and their spouses turn over their stock portfolios to a blind trust before being sworn in.

Senator Ossoff and Representative Spanberger are at the forefront of the push to do so, and they may even manage to successfully pass such a law, because even some Republicans have become either disgusted with the practice or they have just realized how politically potent it would be to ban it. For the time being, though, Ossoff and Spanberger are our winners of this week's Most Impressive Democrat Of The Week. Let's really drain the swamp of Washington a little, what do you say?

Most Disappointing Democrat Of The Week

Because we dinged three Democrats last week for the same transgression, we have to at least give a (Dis-)Honorable Mention award to Stacy Abrams, for posing for a photo in front of a class of masked children. Abrams was bare-faced in the photo.

But unlike California politicians Gavin Newsom, London Breed, and Eric Garcetti, Abrams at least had the intelligence to make a full and unconditional apology, rather than trying to weasel out with a non-apology apology:

Abrams said she followed protocols initially, walking up to the podium with her mask on. The Georgia Democrat, who was at Decatur Elementary School to promote reading and Black History Month, said she then explained to the students why she was removing her face covering to read -- pointing out that she was socially distanced from the kids and that she was also reading for two other classrooms tuned in virtually.

But her next move, joining the children for a photo without her mask, was a mistake, Abrams said on CNN.

"In the excitement after I finished, because it was so much fun working with those kids, I took a picture. And that was a mistake," Abrams said. "Protocols matter, and protecting our kids is the most important thing. And anything perceived as undermining that is a mistake, and I apologize."

Which is why she's only getting a (Dis-)Honorable Mention, because she clearly atoned immediately rather than try to explain it all away somehow.

But this week's Most Disappointing Democrat Of The Week was President Joe Biden, for not making good on his pledge to protect the executive branch workforce from bullying.

When Biden entered office, he made what sounded like an iron-clad promise to everyone working for him: "If you are ever working with me and I hear you treat another colleague with disrespect, talk down to someone, I promise you I will fire you on the spot. On the spot -- no if, ands or buts." But when this unequivocal pledge was put to the test, Biden failed to deliver.

We wrote about this missed opportunity earlier in the week, so we're just going to copy and paste the key excerpts in:

The story starts with Politico, who was researching an article exposing Dr. Eric Lander, Biden's cabinet-level chief science advisor, as being a bad boss. Plenty of evidence of this exists, apparently, as he would routinely berate and belittle people working for him -- women, in particular. Although Lander is seen as somewhat of a technological wunderkind in the medical research area, that doesn't always equate to being a good boss. Or even one that doesn't break workplace rules, for that matter.

After it was revealed that there had been an internal investigation into Lander that did indeed find evidence of Lander mistreating underlings, the White House's initial response was beyond weak. It recommended that Lander do some touchy-feely events with his staff (brown-bag lunches'll fix everything!) and that the whole department (but not Lander himself) undergo workplace sensitivity training.

. . .

But no matter how much interest is paid to this event, it still represents a rather large missed political opportunity. Lander should not have been allowed to resign. He should have been fired. Publicly. Biden himself should have announced this, and rededicated himself to that iron-clad pledge, in a clear message of support for the entire executive branch workforce: "When I said you will be fired, I meant what I said, and when I said 'No ifs, ands, or buts' I meant that too. Anyone disrespecting fellow employees in this manner will be fired, period." A simple statement like that would have reinforced Biden as a straight-talking guy and a man whose word is his bond.

Instead, Lander was allowed to slink off into the night with a resignation. Biden is apparently going to remain aloof from the entire mess. This sends entirely the wrong signal, both to executive branch staff ("he didn't really mean it") and the country at large ("Biden can't be trusted to keep his word"). Instead of chalking up a clear political advantage, Biden instead suffered a clear political black eye. And that is why Eric Lander should have been personally fired by President Biden.

After thinking about it for a few more days, we still feel exactly the same. Biden missed a golden opportunity to stand up strong for the people who work for him. He didn't. He allowed what appears to be a friend of his to gracefully resign. That is not what he promised he'd do. That is not "I promise you I will fire you on the spot. On the spot -- no if, ands or buts." Not by a long shot.

Which is why President Biden is this week's Most Disappointing Democrat Of The Week.

Friday Talking Points

Volume 650 (2/11/22)

[Editor's Note: Have we really done 650 of these? Wow.]

OK, we have to begin today with an apology, because the first of these is, admittedly, far too long to be accurately called a talking point. But it wasn't quite long enough to pre-empt all the rest of them, so we're just going to have a run-on talking point at the start; our apologies....

It is a historical bit of oratory that seems more than relevant today. To give credit where it is due, David Von Drehle of the Washington Post dug this out of the annals of Senate history. In his piece, he notes what happened after this speech was delivered -- the senator giving the speech was forced off a key committee and smeared mercilessly by members of her own party.

The senator in question was Maine's Margaret Chase Smith, who was only the seventh woman senator ever and the first one to win elections for both a House seat (where she started, after the death of her husband left the seat empty) and a Senate seat. The senator she confronted (without ever mentioning him by name) was Joe McCarthy, at the height of McCarthyism. While boarding the underground subway tram that moves congressfolk around the tunnels of the Capitol complex, Chase encountered McCarthy and delivered a stinging rebuke to everything he was doing. It is a completely partisan speech (she denounces the "ineffective Democratic administration" in multiple ways), but one delivered in the hopes of rescuing her own Republican Party from the dark alleyway McCarthy had led it down.

And it resonates today, since after she delivered this blistering broadside to McCarthy she was hounded off a key Senate committee and smeared and badmouthed by McCarthy's allies in the Senate. You know -- just like what Liz Cheney is going through. Which is why we felt it was important enough to provide such an extended excerpt.

 

1
   A Republican Declaration of Conscience

The entire speech is a challenge to the Republican Party to think long and hard about the path it was being led down. Republicans at the time (as now) were the minority party in the Senate and had lost the White House. The speech was delivered on June 1st, 1950.

Surely these are sufficient reasons to make it clear to the American people that it is time for a change and that a Republican victory is necessary to the security of this country. Surely it is clear that this nation will continue to suffer as long as it is governed by the present ineffective Democratic Administration.

Yet to displace it with a Republican regime embracing a philosophy that lacks political integrity or intellectual honesty would prove equally disastrous to this nation. The nation sorely needs a Republican victory. But I don't want to see the Republican Party ride to political victory on the Four Horsemen of Calumny -- Fear, Ignorance, Bigotry, and Smear.

I doubt if the Republican Party could -- simply because I don't believe the American people will uphold any political party that puts political exploitation above national interest. Surely we Republicans aren't that desperate for victory.

I don't want to see the Republican Party win that way. While it might be a fleeting victory for the Republican Party, it would be a more lasting defeat for the American people. Surely it would ultimately be suicide for the Republican Party and the two-party system that has protected our American liberties from the dictatorship of a one-party system.

She ends her speech with an enumerated "Declaration of Conscience" for her fellow Republicans. Here are the two items (out of five) that still strongly resonate today:

  • Certain elements of the Republican Party have materially added to this confusion in the hopes of riding the Republican party to victory through the selfish political exploitation of fear, bigotry, ignorance, and intolerance. There are enough mistakes of the Democrats for Republicans to criticize constructively without resorting to political smears.
  • It is high time that we stopped thinking politically as Republicans and Democrats about elections and started thinking patriotically as Americans about national security based on individual freedom. It is high time that we all stopped being tools and victims of totalitarian techniques -- techniques that, if continued here unchecked, will surely end what we have come to cherish as the American way of life.

   More legitimate political discourse

Maybe we should start just using the initials "L.P.D."? Seems like this phrase is going to be around for a while....

"Just when you thought the Republican Party couldn't stoop any lower or be any more obvious in its sanctioning of political violence, we have a shameful ad this week from a candidate for Senate from Arizona. In it, the candidate -- and I'm going to refuse to say his name so he doesn't get more publicity out of this -- is portrayed as a Wild West sheriff who shoots at actors portraying President Joe Biden, Speaker of the House Nancy Pelosi, and Arizona Senator Mark Kelly. You remember Mark Kelly -- he's the husband of Gabby Giffords. Giffords was -- after another Republican published a map showing her district in a rifle's crosshairs -- the victim of an attempted political assassination when she was shot in the head by a supporter of Republicans. You heard that right -- the husband of a woman shot in the head was portrayed in a political ad getting shot at by a despicable man running against him for his Senate seat. Hasn't the Republican Party already hit rock bottom? Sadly, I guess not...."

   Another state heard from in the L.P.D. department

Just for good measure, this also happened this week.

"The only Black woman in the West Virginia state legislature got a surprise in her email during Black History Month. It came in the form of a despicable ad showing an image of a person dressed in full Ku Klux Klan regalia -- and if that weren't enough, he was giving a Hitler salute. An anti-abortion group seemed to think this was fair game. To send to a Black woman. I guess it's just more of that 'legitimate political discourse' the Republicans are now for, huh?"

   Election fraud in Florida!

Actually, that should be more election fraud in Florida, since a few months ago we learned that the only fraudulent votes the state had found from the 2020 election all came from Republicans trying to vote twice.

"A prosecutor in Florida is now investigating widespread reports from elderly voters in Miami who had their voter registrations switched from Democratic to Republican without their knowledge or consent -- perhaps as many as 5,000 of them. In other words, massive election fraud. By Republicans (of course). Many don't speak English. They were apparently tricked by people wearing Florida Republican Party hats -- a systematic effort to wipe voters off the rolls of the Democratic Party just before a primary election happens. Why is it that for all the loud weeping and wailing from Republicans about supposed widespread election fraud that the only examples that ever happen are ones where the Republicans are the ones committing the fraud?"

   Where is Merrick Garland?

A question on many minds, these days.

"This coming Monday is Valentine's Day, but it is also an important political date as well. Because it will be exactly five years since the first alleged obstruction of justice was committed by Donald Trump. Trump asked F.B.I. head James Comey to drop the criminal investigation of Michael Flynn -- which is pretty clearly obstruction of justice, as Robert Mueller itemized in his report on the subject. Of course no attorney general under Trump was ever going to prosecute him for these possible crimes, but Merrick Garland has been in that job for over a year now and he has nothing holding him back. But this Monday, the statute of limitations runs out on the first of these, and the others will soon follow. Legally, they'll all turn into pumpkins, in other words. So where is Attorney General Merrick Garland? These allegations are about as public as you can get -- there simply is no privacy left to protect. If the Justice Department has found insufficient evidence to prosecute any of these possible crimes, then Garland owes it to the public to explain this. But he shouldn't just quietly allow the clock to run out on all the transgressions contained within the Mueller Report."

   Let me count the ways...

With apologies to Elizabeth Barrett Browning, of course....

"How did Donald Trump try to overturn an American election? Luckily for us, the Washington Post counted up the ways. It was a multipronged effort, and please remember that while they all failed, it would only have taken one to succeed for America to have the worst constitutional crisis since the Civil War. Trump tried to steal an American presidential election with:"

  • Post-election litigation
  • Pressure to prevent certification
  • Efforts to create alternate slates of electors
  • The chase for possible fraud or machine manipulation
  • Attempt to weaponize the Justice Department
  • Pressure on the vice president
  • The effort to harness public pressure -- ending in violence
  • Attempts to deploy the national security establishment

"How did Donald Trump try to steal a presidential election? Let me count the ways...."

   No soup for you!

Just when you think the race for "Stupidest Republican Alive" had been settled, there's yet another new entry.

"Republican House Member Marjorie 'Three-Names' Taylor Greene once again put on display her stunning ignorance -- even on a subject seemingly near and dear to her heart (since she brings up comparisons with Nazis at the drop of a hat).     On 6 January, thousands of Trump supporters gathered at a "Save America" rally organised to challenge the result of last November's presidential election.
    They listened as Mr Trump spoke to them on the National Mall, near the White House in Washington DC.

    In a 70-minute address, Mr Trump exhorted them to march on Congress where politicians had met to certify Democrat Joe Biden's win. The attack began moments after he took the applause.

    So what did he say? Here are five key quotes, followed by some legal analysis from Professor Garrett Epps of the University of Baltimore.

    ’We won this election, and we won it by a landslide'

    This was three minutes into his speech. It was a false assertion that Democrats used as the starting point for the incitement charge - not just because he said it on this day but for weeks before.

    This quote appears in the article of impeachment, the charge that was backed by the House of Representatives, lower chamber of Congress.

    In the months preceding the Joint Session, President Trump repeatedly issued false statements asserting that the Presidential election results were the product of widespread fraud and should not be accepted by the American people or certified by State or Federal officials. Shortly before the Joint Session commenced, President Trump, addressed a crowd at the Ellipse in Washington, DC. There, he reiterated false claims that "we won this election, and we won it by a landslide".

    ’We will stop the steal'

    Here Trump was echoing the slogan of the movement to fight Mr Biden's election victory, which was started a day after the result was declared.

    It soon gathered pace on social media and led to rallies across the US. The largest one yet was the one Mr Trump addressed on 6 January.

    ’We will never give up. We will never concede. It doesn't happen'

    This was Mr Trump saying in the clearest terms yet that he will never accept Mr Biden's win. Referring to himself and his supporters collectively, Mr Trump said there would be no concession.

    He went on: "You don't concede when there's theft involved. Our country has had enough. We will not take it anymore."

    At one point, Mr Trump said the Biden presidency had to be challenged.

    "You will have an illegitimate president. That is what you will have, and we can't let that happen."

    'If you don't fight like hell you're not going to have a country anymore'

    This is the longest quote from Mr Trump's speech that appears in the article of impeachment. It could also be the one that his lawyers will find hardest to defend in the trial.

    He also wilfully made statements that, in context, encouraged - and foreseeably resulted in - lawless action at the Capitol, such as: "if you don't fight like hell you're not going to have a country anymore".

    However, Mr Trump's lawyers have argued his use of the word "fight" was figurative, which has long been accepted in public discourse.

    ‘Peacefully and patriotically make your voices heard'

    This was the part of Mr Trump's speech that his defenders have seized on to show that he never incited the crowd.

    He said: "I know that everyone here will soon be marching over to the Capitol building to peacefully and patriotically make your voices heard."

    The language was very different from other sections, which borrowed more from combat or war.

    Indeed, Mr Trump's lawyers have suggested they will highlight his use of the word "peacefully" in the trial.

    'We are going to the Capitol'

    The president used "we" but he didn't join them as his supporters took the short walk from the rally to Congress.

    He said: "We're going to walk down to the Capitol and we're going to cheer on our brave senators and congressmen and women, and we're probably not going to be cheering so much for some of them."

    Analysis by Professor Epps: What is incitement under the law?

    Incitement is not a crime under the First Amendment unless it meets certain criteria.

    First of all, it has to be intended to cause violence (and you infer that intent from the circumstances). It also has to be likely to cause violence.

    If I go downtown and I say to two drunks standing in front of a bank, "let's rob this bank right now", I haven't really incited anybody, because it's not very likely they'll rob the bank.

    If I say let's meet here tomorrow and rip things up, I'm not inciting because - in the words of the Supreme Court - where there is time for better counsels to prevail, the remedy for speech is more speech.

    The speech has to be likely to cause - and this is very important - imminent violent action.

    If this was a court of law, does Trump cross the line?

    It's quite rare that somebody can be convicted of incitement. In applying that to the president's speech at the rally, it's an agonisingly close case.

    It's pretty goddamn imminent because he's telling people to march to the Capitol and I will march with you. There wouldn't be any time for better counsels to prevail because you're just going to leave the Ellipse and walk down Pennsylvania Avenue.

    He said we have to fight and show strength, but he also said we're very peacefully and patriotically going to ask, so he's covering himself. In the end, I think it's a jury question.

    I'm not sure he's entitled to a dismissal of charges as a matter of law. There's some discussion that government leaders have more leeway, but I don't know how that would play out.

    He clearly knew there were people in that crowd who were ready to and intended to be violent, and he certainly did nothing to discourage that. He not only did nothing to discourage it, he strongly hinted it should happen.
