The Bill of Rights celebrated its 223rd anniversary yesterday. Anyone who believes this is a positive addition to America's history should thank the Anti-Federalists, since they were responsible for the creation of the first ten amendments to the United States Constitution. There aren't a whole lot of folks today who call themselves "Anti-Federalists," so you'll have to salute their memory instead.
There were two big things going on in the political world this week: the release of the Senate torture report, and the cromnibus bill which kept the government open. For the most part, we're going to cover the torture report at the end, in a very unusual talking points section.
One Maryland Republican in the House, apparently still upset that his state donated the land for D.C. centuries ago (or something), pushed an amendment to the cromnibus that would have flat-out overturned the will of the people on Initiative 71, and kept recreational marijuana fully illegal in District law. Democrats indicated that this was a deal-breaker for them (on the entire cromnibus bill), so today a compromise of sorts seems to have been reached.
It is indeed the season. Yes, it's that magical time of year when the wee folk of Capitol Hill actually get something done. These brief bursts of activity only happen very rarely, of course, and always immediately proceed another one of the many, many long vacations Congress takes during the year.
OK, I do realize that everyone is already sick of the term "cromnibus." I'm no exception -- I was sick of it the first time I heard it, in fact. But seeing as how we've only got one more week of talking about it (before it becomes an answer in political barroom trivia games of the future), I felt it was time to stretch the inane metaphor once again. Because today the subject on Capitol Hill is riders. That's right, the riders on the cromnibus.
When Congress wouldn't pass a bill, the president had to act on immigration and deportation policy, to keep families intact -- a measure that affected 40 percent of the undocumented immigrants in the United States. The president in question was George H. W. Bush, and the year was 1990. Congress, at the time, was run by the opposition party. What did they do in response? They passed a bill, which Bush later signed.
"President Obama is an illegal!"
No matter what the president soon announces on the subject of immigration reform, you probably won't hear that line being used against him. There's no real reason why it shouldn't, though, if you follow the logic of those opposed to what they call "amnesty." Instead of: "President Obama is acting illegally," or: "President Obama's actions are illegal," there's no reason -- again, using their logic -- why they shouldn't also be saying: "President Obama is an illegal!" And the reason has nothing to do with his birth certificate.
It's either the morning after, or the mourning after -- take your choice.
Last night, Democrats got well and truly shellacked once again in a midterm election. It was so bad, it's pretty hard for Democrats to even attempt to gild the lily or spot that elusive silver lining. Republicans are consumed with glee, which they've well earned this year.
Happy Election Day, everyone! It being an off-year election, there will be no presidential race to dominate the news tonight as the election returns come in. The biggest races will be in the Senate, with political control of the chamber hanging in the balance. On the House side, the only real question is how many seats the Republicans will pick up. But there are plenty of interesting down-ballot races to watch, while waiting for Alaska's returns to come in late in the night (or, perhaps, the recounting of West Podunk's ballots). I thought, as a preview/guide to tonight's returns, it'd be worth the time to take a quick look at some of the other contests we may be hearing about this evening.
About a month ago, a debate erupted when Apple and Google announced they were going to start providing encryption services for smartphones that could not be cracked by anyone -- including the police. James Comey, the head of the Federal Bureau of Investigations, was horrified at this prospect and began a public-relations push to convince the companies (and the public) that this was a terrible idea. He tried to get the companies to change their decision to (as he put it) "market something expressly to allow people to place themselves beyond the law."
