Here We Go Again

Hey, kiddies, it's time to play "shadow boxing with Joe Manchin" once again! Yes, his teasing game has begun anew, where Democrats get their hopes up that Senator Manchin will finally agree to pass something -- anything -- from President Joe Biden's agenda, in the hopes of counteracting the predicted coming "red wave" in November's midterm elections. Once again, Manchin is playing it coy, as he is "in negotiations" with Senate Majority Leader Chuck Schumer, but has not actually committed to much of anything. The deadline this time around is the end of July, right before all of Congress disappears into the summer breeze for an entire month. Of course, they're all still on their two-week July 4th vacation this week, so nothing will really happen until next week, which leaves a rather abbreviated window.

The game is the same as it has always been: Manchin acts like a little tease, continually getting everyone else's hopes up, but then at the last minute he manufactures a brand new reason why he can't support the deal he just spent many weeks/months negotiating -- and the whole thing falls apart. Manchin, in the meantime, gets all the Sunday morning political interviews he wants, and generally is the center of Washington's attention while the dance goes on.

To say this is frustrating to all the other Democrats is understating the matter, at this point. Which is why we went with "Here We Go Again" as a title, today. It feels like "fool me five or six times..." at this point, it really does.

As things stand, reportedly, Manchin is near to agreeing on two major parts of the budget reconciliation legislation: energy and healthcare. The Washington Post reports:

While top [Senator Joe] Manchin aides say they are far from a deal, some Democrats are still hoping to finalize a retooled climate proposal as soon as next week, when lawmakers are set to return from recess, according to two people familiar with the matter, who spoke on the condition of anonymity because they were not authorized to comment publicly. Already, party leaders have held advanced discussions with the West Virginian on spending to combat climate change, including how to curb emissions of methane, a potent planet-warming gas, the individuals said.

But, alas, Manchin's staff was quick to pour some cold water on such speculation:

"Suggestions that a reconciliation deal is close are false," said Sam Runyon, a spokesman for Manchin, in a statement. "Senator Manchin still has serious unresolved concerns and there is a lot of work to be done before it's conceivable that a deal can be reached he can sign onto."

Justin Goodman, a spokesman for [Senate Majority Leader Chuck] Schumer, said any mention of a final deal is "speculation," adding: "We continue to have productive conversations."

Two other items seem to have advanced as well: lowering prescription drug prices (an incredibly small-bore measure to do so, but still better than nothing), and shoring up the Medicare trust fund. The first, from an AP article:

Democrats this week also sent the parliamentarian a separate 190-page piece of the emerging Schumer-Manchin compromise aimed at lowering prescription drug costs of patients and the government. Provisions include requiring Medicare to negotiate drug prices, limiting beneficiaries' out-of-pocket costs to $2,000 annually and increasing federal subsidies for copays and premiums for some low-income people.

And the second, which actually has a method to pay for it:

At issue are growing fears that the health insurance program for elderly Americans could run out of money in 2028. While Medicare's financial outlook has improved recently, the program's trustees in recent months have issued dire warnings about the consequences of sustained congressional inaction.

In response, Democrats have drafted a new plan they hope to include in a broader economic spending deal. Party lawmakers specifically seek to impose taxes on high-earning Americans, who would have to pay a 3.8 percent tax if they own a kind of business called a pass-through, according to a person familiar with the matter, who spoke on the condition of anonymity to describe the process. That aims to close what Democrats long have decried as a tax loophole and sustain Medicare's key trust fund until 2031.

All three of these things -- some action on climate and energy, cheaper drug prices, and shoring up Medicare -- are popular and would be good to accomplish. But there is a whole raft of other issues from the original Build Back Better bill that Manchin doesn't seem to be close to considering. Such as capping the price on insulin -- there are many other issues even within the subject of healthcare reform that haven't been addressed yet. The increased subsidies for Obamacare insurance policies are going to turn into a pumpkin at the end of this year, which means notices from people's insurance companies outlining next year's price hikes will probably go out right before the midterms -- which makes this a rather important political issue that needs fixing soon. Beyond healthcare and climate change/energy, there are a whole bunch of other good ideas that will probably not even make into anything Manchin gives the nod to. Currently, the reports just mention a few of these that might possibly see the light of day: reforming corporate taxes, changing tax laws to comply with Biden's international corporate tax idea, and perhaps giving the I.R.S. some more money to collect unpaid taxes. Those are all pretty small potatoes, but at least it's something.

One piece of this puzzle that no media stories (that I have yet seen) have mentioned is whether Senator Kyrsten Sinema is on board with any of it. Sinema is different than Manchin -- Manchin is most interested in protecting his home state's coal industry as much as possible, while Sinema is more widely concerned with the horrendously-high tax rates that the wealthiest taxpayers and largest corporations are somehow forced to endure. Sorry for getting snarky, but that is indeed her position -- none of the gigantic giveaways in the Trump tax cuts can ever be revoked. But for some reason, nobody's asked her about the tax proposals in any of this. Maybe she's just waiting her turn in the "make all the other Democrats' heads explode" tag-team match with Manchin? Who knows, at this point....

The most representative quote from the entire rest of the Democratic Party came in that first Washington Post article, and it is where we are going to end this today (so we don't get even snarkier about having to play Manchin's twisted game once again). Because, at this point, Ro Khanna is right:

The overall price tag of the climate and energy provisions in the spending bill could total around $300 billion to $350 billion, though the amount will change as negotiations continue. That pales in comparison with the $555 billion climate package in the earlier version of the bill that passed the House last year.

Manchin has argued that such spending could add to the national debt and worsen inflation as prices are skyrocketing. But the smaller amount on environmental programs may be difficult to accept for some liberal House lawmakers, who view the measure as their last chance to pass robust climate legislation before the midterm elections this fall, when Republicans could wrest control of Congress.

"I wanted more than $555 billion to meet the moment on climate," Rep. Ro Khanna (D-Calif.), deputy whip of the Congressional Progressive Caucus, said in an interview Thursday. "I was in meetings at the White House where I pushed for more."

However, Khanna said he would encourage fellow liberal House members to accept any climate deal that emerges in the Senate.

"The alternative is zero dollars," he said. "Significant investment is much better than zero."

    This man, who retired as a full time police officer two years ago, is charged with statutory rape charges. Thus, we have legal adulthood being reached at different ages depending on where you are geographically. In some places you are an adult at 15, others it is 18. And except for the state of Louisiana, the rest of the country says your aren't "adult" enough to buy alcohol until you are freakin' 21.

    I had a good friend in college who met a girl at a party and they went back to his dorm so he could lose his virginity (she was not a virgin, according to her own words.) The next day, her father shows up at the college searching for his precious daughter who turned out to be underage. She had a fake ID that she used to get into a bar, so my friend believed that she was over 21, but she was only 15. Luckily for my friend, his dorm mate was sick and was on the top bunk covered up and sleeping. He came forward and said that SHE kept waking him up with her screaming and ordering his roommate to perform various sexual acts for her. It was clear who the aggressor was in that encounter.

    Luckily, her pastor father did not want it getting out what his daughter was doing in her free time, and realized it would be wrong to make my friend have to register as a sex offender for the rest of life because of his daughter's deception. That's the only way my friend avoided jail and being labeled a sex offender -- the victim recanted.

    Laws with mandatory sentencing guidelines that do not allow the court to have any say in how it rules should be banned from our justice system.
