The Sexual Revolution Is Over. Sex Won.

Conservative Republicans just chalked up another big defeat in their continuing losing streak in the culture wars. The Supreme Court ruled today that L.G.B.T. rights are indeed included in Title VII, which mandates equal treatment for all "on the basis of sex." Discriminating against someone because they are gay or transgendered (by firing them, for example) is just as unconstitutional as it is to discriminate against all women (or all men, for that matter). To put it another way, what could be called the final battle of the Sexual Revolution just ended, and the counterculture has now absolutely routed the field of conservatives.

Astonishingly, the decision was 6-3. Chief Justice John Roberts seems to be emerging as the key swing vote on the high court, likely because his name is on it (it'll be more his legacy than that of the other eight if "the Roberts court" issues a monumentally bad decision, in other words -- and he knows it). But added to the four liberals on the court, this still only means five votes. The truly astonishing thing is that a justice named by Donald Trump was the sixth vote for equality before the law.

It was not Justice Fratboy who joined the majority. It was, in fact, Justice Stolen-From-Merrick-Garland, who actually wrote the majority opinion. He based his reasoning on what he considers sound conservative legal thinking -- namely, that it is impossible to discriminate against someone because they are gay without doing so "on the basis of sex," as the law clearly states. He reasoned that if two people who were both attracted to men were to be treated differently by an employer because one of them was male and one was female (which is the essence of discrimination against a gay man), then of course they were being discriminated against because of their sex. Justice Stolen-From-Merrick-Garland did admit that the legislators who wrote the text of the law almost assuredly did not intend the law to be read this way, but that it was actually impossible to read the law any other way. Since the law says what the law says, he reasoned, then L.G.B.T. discrimination is forbidden, period.

This will not be the actual end of the culture war over gay people (and all sexual freedom), but it is likely to be the last major battle. The victory at Yorktown wasn't actually the end of fighting in the American Revolution, but it was the final decisive battle, and thus it is remembered as being the point where the war was won. While some already saw the Supreme Court decision legalizing gay marriage as representing this final victory, it really wasn't, since there were no state-level anti-discrimination laws protecting gay people in roughly half of the states. So gay people could get fired or otherwise discriminated against purely because they were gay in plenty of places in America. That ends today.

Of course, there will still be minor skirmishes before this culture war is completely over. President Donald Trump -- on the wrong side of history, as always -- recently overturned yet another Obama regulation, which insisted on nondiscrimination in medical insurance. Trump has now officially freed up health insurers to deny people policies because they are gay or transgendered. Trump also continues to try to limit L.G.B.T. people in the military as much as he is able, to turn back the clock even further. But with the court now signaling their strong opposition to such moves, these efforts will almost assuredly fail, in the end.

The Sexual Revolution meant a lot of things to a lot of different people and groups. The first major victory was Griswold v. Connecticut, which legalized birth control for all women. Even (gasp!) unmarried women. The very notion of a state being able to make The Pill illegal is a strange one to even consider, nowadays, but that is really the true measure of how far we've come. The "free love" hippies and the Stonewall protesters used to be referred to as the "counterculture" because they were seen as being so far out of the mainstream of American life that they actually ran counter to it. This is no longer the case. Sex is no longer the taboo subject it once was. Sexual behavior is now seen as a personal decision, not something the government should even be trying to regulate. With today's decision, the government finally firmly came down on the side of the counterculture, in essence stating that the culture itself has changed so much that the definition of discrimination now has to encompass everyone -- no matter how "counter" anyone else thinks they are.

This isn't to say that the conservatives have changed their tune much. The Republican Party continues to cling to their outdated definition of who truly belongs to American culture (at their peril). Their party platform still states their strong opposition to marriage equality, even though they don't talk about it as much anymore. Donald Trump is still free to try to impose legalized discrimination as long as he is president. Just last week in Virginia, a Republican member of the House was just ousted (not by an actual primary but by a party convention, but "primaried" just the same) for the sin of actually officiating at a gay wedding. So it's not like Republicans have given up this fight or anything. As of this writing, Trump has yet to tweet about the court's decision, so we'll have to wait and see what direction he decides to take, at this point.

Democrats are already on board with being anti-discrimination, of course. Because they didn't know how the Supreme Court was going to rule, the House passed a bill earlier to specifically add explicit L.G.B.T. language to the law prohibiting discrimination. This bill -- along with hundreds of others -- is gathering dust over in the Senate. Even though it is pretty hard to envision Mitch McConnell deciding to do the right thing at this point, sooner or later such a bill will become law (likely with a Democratic House, Senate, and Oval Office). So it's pretty easy to see which side the two major parties are on in this fight.

The long arc of history has bent towards justice today. Getting fired for being gay should be unconstitutionally illegal in this day and age -- and it now is, thanks to the Supreme Court. The final skirmishes still have yet to take place, but the Sexual Revolution is now really largely at an end. The moralists and the anti-sex factions have lost. They put up a good fight -- these battles have been raging since the 1960s, after all -- but they could not turn back the tide of public opinion which has become a whole lot more liberal on the question of sexual behavior in the intervening decades. The pro-sex forces have just added to their roster of victories, continuing a winning streak which has only been accelerating over the past ten years or so. Which is why I say that even though there may be a few rear-guard battles left to fight, the Sexual Revolution is now over. Sex won.

    I loved working for YoungLife, it was my dream job and I loved the folks I worked with, but I finally realized that I could not honestly claim that I wasn’t gay...so I had to resign. I did not want to fight for my job, thinking it would harm the organization if I did. I still hope that they will change their ways...because I know that there are folks on staff there today struggling the same way I did.

    presumably the religious right's next move is to try to carve out a first amendment exception to title VII, for organizations like the one russ worked for. i'm guessing they will claim that a LGBTQ person's right to non-discrimination is offset by the other employees' right to do business based on their religious beliefs - kinda like those pharmacists who refused to fill prescriptions for birth control.

    Doubtful! Remember all the controversy over baking a cake for a gay wedding? Even though there are laws in some states and localities against that kind of discrimination, there are still those who try to claim and use or hide behind their religion and free practice there of in order to justify their discrimination against gay people, because their religion supposedly teaches or requires them to do so as part of their religious practice.

    Chief Justice Roberts simply went along with the Liberal side so HE would be the one who actually wrote the opinion.. That way, the opinion could be tailored and narrowed to fit the conservative opinion...

    Had CJR NOT sided with the liberals, then the liberals still would have won, but it would be RBG who would write the opinion and CJR knew THAT opinion would be overly broad and be totally against what Conservatives wanted...

    CJR's vote was tactical in nature, allowing the conservatives to control the narrative and write the opinion in the way the conservatives wanted it written...

    Quite the genius, Chief Justice Roberts is, eh?? :D

    The shooting death this weekend of Rayshard Brooks is tragic. It also does not appear to be a cut-and-dried case of wanton police brutality, despite what you may have heard from news reports.

    “The family of Rayshard Brooks, an unarmed black man who was shot twice in the back by a white Atlanta police officer on Friday after he fell asleep in his car, have called for murder charges and a radical overhaul of the city’s police department,” the Guardian reported Monday.

    Earlier, on Sunday, MSNBC ran a segment that claimed Brooks was “an unarmed African American man.”

    This does not quite appear to be the whole story.

    On Friday, Atlanta police officers responded to complaints that Brooks had fallen asleep in his car in a Wendy’s parking lot. What began as a sobriety test reportedly spun out of control, turning into a violent altercation between the officers and Brooks, who supposedly had been drinking. In the ensuing struggle, Brooks allegedly took an officer’s Taser. The Atlanta man then broke free from the tussle and began to flee on foot. As he made his getaway, Brooks appeared to fire the stolen Taser at one of the police officers, who responded by using deadly force. Brooks was shot and killed. The Fulton County medical examiner ruled Sunday that the man's death was a homicide.

    Witness videos uploaded to social media shortly after the incident appear to show Brooks stealing and firing the Taser at the officers. The Georgia Bureau of Investigation also said in a statement made available at around 7:30 a.m. on Saturday that Brooks had attempted to use the stun gun on the officers. Footage made publicly available that same day appears to back up this version of events.

    Trump’s budgets have routinely proposed police cuts
    In early February of this year, the Trump administration proposed a 58 percent cut in the federal government’s COPS Hiring Program, a federal program that supports police department staffing. That’s not a one-off; his administration’s budget proposals have routinely called for huge cuts to this program, which was inaugurated in the 1990s as part of Bill Clinton’s pledge to hire 100,000 new police officers (Congress keeps declining to do this).

    An Air Force sergeant and leader in an elite military security force, Carrillo was armed with homemade bombs, an AR-15 rifle and other weapons and had a desire to harm police when he launched a deadly attack on unsuspecting officers, the Santa Cruz County sheriff said Monday.

    Officials said Tuesday that Carrillo and Justus were not part of the protests and were taking advantage of them to carry out their attacks.

    Brian Levin, executive director of the Center for the Study of Hate and Extremism at Cal State San Bernardino, said Carrillo on social media including Facebook posts had become increasingly disturbing.

    Levin said he said he shared memes about the so-called “Boogaloo” movement, a right-wing extremist group that anticipates civil war. Levin said the far-right groups are now more of a threat to government and law enforcement.

    “Our research shows 27 far-right extremist connected homicides,” Levin said i. 2019. The FBI arrested three associates of the Boogaloo movement in Nevada, recently and they were charged with inciting violence with Molotov cocktails at protests.

    Levin said Boogaloo followers range from ultra libertarians to white supremacists but they all share a belief in a second Civil War coming.

    “They are Second Amendment insurrectionist,” Levin said. “The boogaloo boys believe in arm insurrection and include attacks on the police.”

    FBI Special Agent in Charge Jack Bennett said that Carrillo used a private made firearm - a so-called ghost gun built using an unmarked receiver to kill the federal officer. Bennett would not say whether Carrillo made that gun or someone else.

    Roughly 1.1 million people in the U.S. are currently living with HIV, and nearly 40,000 Americans become infected with the virus each year, according to government data.

    Last year, Trump’s pledged to end the HIV epidemic in the United States by 2030, a goal that public health advocates have cheered and sought for years.

    The comment came as the U.S. also works to develop a vaccine for the deadly coronavirus, which has infected more than 2.1 million Americans and killed at least 116,341, according to data compiled by Johns Hopkins University.

    Earlier Tuesday, Trump administration officials said the coronavirus vaccine will be provided free of charge to Americans who can’t afford it.
