Piercing Trump's Tax Deflection

You could call this whole article an open letter to Lester Holt, I suppose. But it's really directed towards anyone at all in the media, because from what I've seen so far they all are missing the chance to ask Donald Trump a painfully obvious followup question, and instead are following Trump down a rabbit hole of his own making.

Here's a quick rundown, which should be fairly self-explanatory. The basic question:

Why haven't you publicly released your tax returns, Mr. Trump?

Trump's answer, invariably, is that he's under an audit and therefore his lawyers and tax professionals have advised him not to release his tax returns publicly. Now, this may be a fantasy inside Trump's own head, since he's never even managed to make public a letter from the I.R.S. clearly stating he is being audited (which wouldn't reveal anything other than that the audit did, in fact, exist). This is where the rabbit hole begins, though, because here are the usual followup questions asked when Trump trots the audit excuse out:

But even if you're being audited, there is nothing legally stopping you from publicly releasing your tax returns -- Richard Nixon actually released his while he was also under an audit. So why not just release them anyway, Mr. Trump?

There's a second followup which also winds up down in the warren, entering through a slightly-different rabbit hole:

So when will you release these tax returns? Will you release them when the audit's over?

Trump has been asked this second one directly (multiple times), to which he smilingly responds that of course he'll release his recent tax returns, immediately after the (unverified) audit ends (at some unverified date).

Hearing either of these followups makes me want to bang my head against a wall. Maybe even a big, beautiful wall, facing south. Because both of them get bogged down in the details of the (possibly fictitious) audit, which falls right into Trump's trap. He then waffles on about how being audited is a pain and how nobody in their right mind would publicly release returns currently being questioned by the I.R.S. It allows him to run out the clock talking about audits, rather than answering the basic question at all.

So, to Lester Holt -- or to any other reporter with access to Trump -- here is the way the followup question desperately needs to be asked:

OK, fine, you say you're being audited -- but audits don't go back forever. You've said your current audit goes back to the tax year 2009. So what possible reason do you have for not releasing your 2008 tax return to the public? Why not release five years from the 2000s, so the American public can see if you are telling the truth about your wealth, your income, your tax rate, and your charitable giving? Because many are saying you are hiding something in your tax returns which contradicts your own public statements.

That is the question which should be asked of Trump, but (to date) I have never heard from any reporter. Dodge around Trump's own audit dodge, and get to the heart of the matter -- Trump is scared to release any tax return, because assumably there's something in all of them which proves he's not been honest about either his supposed business prowess or his supposed philanthropy.

Asking the question about his pre-audit tax returns ignores the whole open question of whether the audit even exists. Give Trump the benefit of the doubt, rather than wasting precious debate (or interview) time falling down the same rabbit hole all the other reporters seem powerless to avoid. Under audit? Fine. Then what about all the years previous to the years being audited? Hillary Clinton, after all, has released decades of her tax returns -- one of the most in-depth tax dumps of any candidate in history, in fact. So it is indeed possible to compare her 2008 (or 2007, or 2006, etc.) tax returns to Trump's, if he would only release them.

Without the audit to get distracted by, the question shifts back to the basic form: "Where are your tax returns, Mr. Trump?" If he even mentions the word "audit" in his answer, cut him off immediately by saying: "But I'm talking about the years before your current audit." This solves the problem, avoids the rabbit hole, and counters Trump's dodge (pick your metaphor). It gets back to the basic question of why Trump is scared to release any tax return at all.

To me, this followup question is blindingly obvious. Which is why I've been downright astonished that Trump has yet to be asked, to his face, about any tax returns previous to his claim of being under an audit. Instead, reporter after reporter goes down one of the rabbit holes and doesn't ever get a clear answer from Trump.

Lester Holt has the opportunity to rectify this mistake, once and for all. He is fully aware of the criticism which was (deservedly) heaped upon Matt Lauer, for his own dismal performance at NBC's pre-debate. Holt has a much higher bar to clear, to be blunt. Which is why I'm offering up what is, to me, the most obvious question that Trump has yet to answer. Asking Trump about prior years to the audit avoids the whole "let's fact-check Trump's audit story" red herring altogether. But, so far, nobody has bothered to ask him. So Lester Holt could hold Trump's feet to the fire while at the same time avoid the whole controversy about real-time fact checking.

As we get closer to the first debate, I will likely write another one of these articles as a plea to Lester Holt -- most likely, with questions I'd like to hear asked of both Donald Trump and Hillary Clinton. But for now, I'm offering up this question to any political journalist worth the job title -- please ask the question that really needs to be asked, rather than always getting distracted. Trump is obviously hiding something -- and at the very least, he should be forced to admit this fact to the American electorate.
