Donald Trump's war of choice with Iran ground to a stalemate this week, and it doesn't seem like progress will be made any time soon. One week ago, Iran announced (as a goodwill gesture, most likely) that the Strait of Hormuz was open once again. Trump then made a slew of sweeping announcements of his own (as a bad-will gesture) and refused to drop his blockade of Iranian ports.

Trump is attempting to define the war the way he usually does, by gaslighting and openly lying, in the hopes that everyone will start believing his lies rather than paying attention to reality. Or just by constantly contradicting himself, showing he doesn't really have a clue as to what is really going on. The Iranians, however, aren't playing his game. They responded with a withering: "The President of the United States made seven claims in one hour, all seven of which were false. They did not win the war with these lies, and they will certainly not get anywhere in negotiations either." Iran then promptly closed the Strait back down and attacked two ships (to show they were serious). So the U.S. attacked an Iranian ship and seized it by force. The Iranians responded by seizing a few ships by force in the Strait.

The Beach Boys were one of those rare iconic bands that pretty much everyone loved to some extent or another. To put it another way, you could play their songs at any random party and it'd be rare than anyone objected. There aren't many such bands around (Creedence Clearwater Revival, the Beatles, maybe the Steve Miller Band and a handful of others) and their rarity is due to their being able to create music that was pretty universally appreciated. It's pretty hard to hate a song like "Good Vibrations," right? Their harmonization was second to none as well. Their music was dated, to be sure (it arose from the surf craze of the 1950s), but it was the best of the era (although Jan and Dean fans might quibble with that statement, to be fair). For the most part, it just made people happy to hear it. Which is exactly why Brian Wilson will indeed be missed.

The last time he was president, Donald Trump faced a big crisis. His response to the COVID-19 pandemic was erratic at best (and even that's being charitable). Later, he and his followers demonized the doctors and medical experts who were desperately trying to save lives with their advice and recommendations -- so threateningly that President Joe Biden felt the need to pre-emptively pardon Dr. Anthony Fauci right before he left office. Biden feared that Trump would harass Fauci via the Justice Department, so he precluded it from happening.

This time around, President Trump is pre-emptively taking a wrecking ball to the federal government's medical establishment, in what can only be called a war on medical science. It was telling, during the early months of the COVID crisis, that Trump kept complaining that we were doing "too much testing." The numbers of people infected and hospitalized and dying were shooting up dramatically, after Trump had promised the country that they wouldn't. The solution, as far as Trump was concerned, was to just stop testing everyone. That way, there wouldn't be any big numbers to alarm everyone. Hey presto! Problem solved!

And so we come to the final Friday Talking Points of President Joe Biden's term in office.

It is perhaps appropriate that the funeral of Jimmy Carter happened in the midst of Biden winding down his final weeks. Because Joe Biden -- another one-term Democratic president like Jimmy -- will likely become more appreciated as time goes by, just as Carter was.

Joe Biden had a pretty spectacular first two years in office, in terms of getting legislation passed. Granted, he had a Democratic Congress to work with and the continuing crisis of a pandemic to spur the politicians to actually act. He used both to get a sweeping agenda passed which will have an impact for years to come. But he had to grapple with two corporate-friendly Democrats in the Senate who held him back from achieving an even-more-historic agenda. If the full "Build Back Better" plan had made it past Joe Manchin and Kyrsten Sinema, then Americans would doubtlessly feel a lot differently (and better) about government's role in their economic lives.

Donald Trump got his start in politics by infamously pushing the "birtherism" lie about Barack Obama. Now he's pushing what might be called a "burgerism" lie about Kamala Harris -- that she somehow just made up the fact that she worked at McDonald's back when she was a student. It's all a measure of the desperation Trump finds himself now wallowing in, since to date none of his attacks against Harris have even come close to landing.

It has now been announced that CNN's Dana Bash has won the journalistic sweepstakes and will be conducting a joint interview with Vice President Kamala Harris and Minnesota Governor Tim Walz on Thursday. This will fulfill a promise Harris made to sit down for an unscripted interview with the media before the end of the month.

Which directly leads to the question of what Harris and Walz should be asked about on Tuesday. So putting on our late-summer "If It Was Me" thinking cap, here are the questions I would ask Harris and Walz, if they were sitting down with me for an interview.

For the past few weeks, JD Vance has been mightily trying to paint Tim Walz as having somehow claimed some "stolen valor" for his 24 years of honorable service in the National Guard. This required him to completely ignore the fact that Donald Trump got a deferment for non-existent "bone spurs" to avoid going to Vietnam, as well as Trump's naked contempt for those who do serve in the military. But hey, all that was a long time ago, and people have mostly forgotten how Trump denigrated an authentic war hero (John McCain) in 2015, so Vance just kept trying.

Maryland Governor Wes Moore today signed a blanket pardon that covers 175,000 marijuana crimes committed in the state, reaching back to the 1980s. It could wind up covering even more, since records older than that are stored on paper -- meaning they will not be automatically pardoned, but if people from back then apply for one they will also get a pardon. This already covers an estimated 100,000 people (some of whom have multiple marijuana offenses). Moore is following in the footsteps of other states and jurisdictions who have already either pardoned or expunged criminal records for simple marijuana possession or use. What this all means is that not only is the War On Weed ending in state after state, but in some places people are retroactively trying to heal the damage the War On Weed has done to millions of people.

The biggest political news of the week by far was Hunter Biden being convicted in record time on all three felony gun charges lodged against him. The jury spent only about three hours before returning these verdicts, which completely undercut the narrative Donald Trump has been spouting about how the justice system is "two-tiered" -- by which he means: "weaponized against Republicans while Democrats get a free pass." Kind of hard to make that argument when the president's own son just got convicted of felonies and is facing up to ten years in prison.

There was significant news today on reproductive rights, from two separate directions. The Supreme Court unanimously (!) overturned a case that challenged the F.D.A.'s approval of mifepristone, one of the two most commonly used abortion pills in the country. The unanimity was possible because the high court essentially punted on the legal question and instead ruled that the plaintiffs had no legal standing to bring their case. Meanwhile, in the Senate, a bill to create a federal right to in-vitro fertilization failed, mostly on party lines. Last week a bill that would have given federal protections to contraceptives also failed. Both will be used in campaign advertising by Democrats to paint Republicans as being against both contraception rights and I.V.F.

According to Donald Trump and all his echo-chamber sycophants, President Joe Biden exerts an amazing amount of control over the entire country's judicial system. He has "weaponized" the Department of Justice, he has been waging "lawfare" against Trump, and his control reaches all the way down to state and local prosecutors as well. Biden pulls the puppet strings, according to them, and the entire judicial system dances to his tune. He uses this evil influence to "persecute" Trump (and, by extension, all his fellow Republicans). Trump swears retribution if he is re-elected (meaning that the entire scenario is probably just projection of his own desires).

Presidential debate announcements, Michael Cohen testifying, and The Jerry Springer Show breaking out in a House committee -- it's been an eventful political week all around, folks!

But we have to begin today with a very sobering piece of data, just to put everything in some perspective. We (rather obviously) personally live and breathe the political scene, and it is a fair assumption that anyone who regularly reads this column all the way to the end (a weekly marathon, 'tis true...) is also pretty plugged in to the follies of the everyday political landscape as well. We all pay attention, in other words. Not just to the large and meaningful events, but also to the small and amusing. But it cannot be repeated enough: this is not exactly normal. Most Americans just don't pay all that much attention to politics. Like, at all.

Today it was confirmed that the federal government is finally going to officially retreat in fighting the War On Weed. The feds are backing down, for the first time in modern history. The Department of Justice is recommending moving marijuana from Schedule I of the Controlled Substances Act to Schedule III, after a required period of public commentary. It is not a complete capitulation in the War On Weed, but it is indeed a historic step in the right direction -- and the first one ever taken. So while this is not the end of the road for the pro-legalization activists, it is an enormous milestone and should be celebrated (even as only a partial victory).

Up until the advent of Donald Trump in American politics, there had been a pervasive attitude among many politicians that there were certain norms and traditions that had been established and long-followed, so there was no need to codify any of them into actual laws. One of these was the belief among Democrats that Roe v. Wade was settled law and that as time went on it had become increasingly impossible to even consider that it would ever be overturned. The judiciary had staked out certain rights, so there was no need for Congress to enact the same rights -- doing so would actually be redundant.

There is an effort underway to reform the federal judiciary in one particular aspect -- but it will not completely end the practice which spurred the reform, and already Republicans in Congress are pushing back by declaring that new laws must be passed instead of just a new rule from the judiciary. This isn't too surprising, since conservatives have had much better luck using the tactic to achieve the outcomes they desire in federal courts.

The practice is known as: "forum-shopping," or even more colloquially: "judge-shopping." If an organization wants to attack a law or policy in an attempt to get it declared unconstitutional and overturned, they seek out a plaintiff who happens to live in a judicial division that all but guarantees they'll get a very friendly federal judge to hear their case. This can lead to injunctions being handed down that affect not only the people in that district, but in the entire state or even the entire country. Rather than taking their chances with some random judge, one is pre-selected before filing the suit -- a judge who can be counted on to rule for their side.

Welcome to the first installment of our year-end awards!

As always, we must begin with a stern warning: this is an incredibly long article. So long you likely won't make it to the end, at least not in one sitting. It is -- as always -- a marathon, not a sprint.

We have tried to credit readers' nominations where we could, but writing the whole column is such a frenzied activity that we may have omitted the citations here and there -- for which we apologize. Reader suggestions make our job putting together this list a whole lot easier, and we are indeed grateful for the people who do take the time to do so (and you still have a chance to make nominations for next week's awards, we would point out).

OK, since it is so long, let's not make it any longer and get right to it. Here are our winners for the awards categories first created on the McLaughlin Group television show, for the year that was.

We return after our extended holiday break to a growing realization in the political world. We had already come to this conclusion a while back, but it seems more and more people are now realizing that, barring any force majeure appearing on the horizon, Donald Trump is going to be the Republican nominee for president next year. His polling tells this story plainly: Trump is up roughly 50 points over his nearest competitor nationally, and although his lead isn't quite as commanding in the early-voting states, it is still pretty daunting (Trump is up roughly 30 points in Iowa, New Hampshire, and South Carolina). Voting will begin next month, meaning there just isn't much time left for any of this to change -- and no real reason to think it will.

President Joe Biden seems to be having some trouble getting young voters enthused about voting for him next year. There's a very simple answer to this problem -- one that he should adopt as soon as possible. He should announce that he has "evolved" on the subject of legalizing the recreational use of marijuana for adults, and unveil a new plan to make it happen on the federal level. This wouldn't be anywhere near as risky as the first time the word "evolve" was attached to Biden getting out in front of a political issue. For Biden, it'd be seen as a real Nixon-goes-to-China shift in position, which would only add to its appeal. And it is tailor-made to get young voters to the polls in droves (as well as plenty of older voters as well).

Donald Trump just gave the team working to re-elect President Joe Biden a rather large early Christmas present. Apparently, Trump has never gotten over his failure to enact "a full repeal" of the Patient Protection and Affordable Care Act (otherwise affectionately known as "Obamacare"). This involved the big dramatic scene with Senator John McCain turning in a "thumbs-down" vote on the Senate floor, in literal fashion -- which was a complete humiliation for Trump. A humiliation, like all the others, that he's never forgotten or gotten over. So he's looking to re-fight that particular battle, it seems.

There were supposed to be three big political stories this week, but in the end two of them turned out to be duds. Donald Trump testified at his New York fraud trial, but without video or audio recordings of him answering questions under oath, the impact was significantly lessened. The other Republican presidential candidates (the five who qualified, at any rate) met for their third Republican debate, but it mostly turned out to be a snoozefest.

Tuesday night, however, more than lived up to expectations. The off-year elections which were held ended up as a big night for Democrats almost across the board. Put quite simply: abortion rights won. Big time. Everywhere.

This week is going to be chock full of big political stories, including Donald Trump testifying in his fraud trial in New York today and the third Republican debate on Wednesday. But today I thought it was worth taking a look at the other big political story of the week, since tomorrow's elections have several interesting possibilities that could reverberate beyond the borders of the states where they are held. Three states in particular are going to be impactful, no matter what the outcomes may be: Mississippi, Virginia, and Ohio.

Polling for the likeliest of general election matchups this far out -- almost exactly one year until people actually get to vote for president next November -- cannot be seen as definitive, but it also cannot be brushed aside as irrelevant (since it's pretty obvious at this point that both Joe Biden and Donald Trump are going to wind up winning the two major parties' nominations). But it won't actually be just a two-man contest, since there will be other names on the ballot, in what is likely to be enough states to make a big difference. Both Robert F. Kennedy Junior and Cornel West have announced they are going to be running as independents, and who knows who the Green Party or the nascent No Labels effort will decide to nominate? At the very least, there may be four names for voters to choose from. Perhaps even five or six.

After three weeks of junior-high-school levels of adolescent slap-fighting, Republicans in the House of Representatives finally (!) chose a speaker. Was this largely due to fatigue at how tawdry the whole clown show was, or was it the fear that some moderate members were actually considering working with Democrats to come up with a solution? We'll never know, but we certainly are glad it's over. For now, that is. The rule on the "motion to vacate" hasn't changed, so while Speaker Mike Johnson seems to be enjoying something of a honeymoon period with even the furthest-right of his caucus, things could always go south for him, since all it would take would be five disgruntled Republicans to kick him out too. And disgruntled is what MAGA extremists do best, so we'll have to see whether this comes to pass or not in the weeks ahead.

It is rare in American politics when Democrats manage to win a political "messaging" war with Republicans, but it certainly seems like they've got a doozy of an opportunity to do just that, on the issue of lowering prescription drug prices. This messaging battle really began in earnest this week, and so far Republicans are losing badly.

Could we finally be approaching the official end to the federal "War On Weed"? That possibility now exists thanks to the Department of Health and Human Services, who just made a recommendation to the Drug Enforcement Agency. And while it is not the unconditional surrender that pro-cannabis activists have been hoping for, it certainly would be the first major retreat in this metaphorical battlefield ever. If the H.H.S. advice is adopted by the D.E.A., the federal government would scale back a position that can only be described as "Draconian," and instead adopt a position that is a whole lot closer to reality.

The nation celebrated its 247th birthday this year, leaving only three more to go until the second-biggest celebration of our lifetime (as we still personally remember the ushering in the bicentennial in Washington D.C.). But since it was a short week, what with Independence Day falling on a Tuesday, we are hoping this will be a short column (for once). Well, short-ish at any rate. We are cautiously optimistic.

Cautious optimism is a good place to start, actually. We stumbled across an interesting paper from two Democratic strategists (Celinda Lake and Mike Lux) which confidently states: "All the elements are in place for a big Democratic victory in 2024," and predicts that the "trifecta" of winning the House back, holding the Senate and keeping Joe Biden in the White House is well within grasp.

Because it is a slow political news week (and for the salacious nature of it all), the mainstream media is currently digging into every aspect of the "Cocaine Found At White House" story. News articles are being written summarizing all possible past rumors or actual instances of drug use at the White House. My favorite came at the end of a Washington Post article on this theme, under the heading: "Rocker Grace Slick." But I found their rundown of what happened awfully sparse, so as a public service today I am going to run an extended excerpt from Grace Slick's autobiography Somebody To Love, of which (of course) I have my own copy (signed and personalized, even...).

There were two notable deaths in the world of politics today, both of which inspire such strong negative feelings within me that I have to step outside the norm of: "De mortuis nihil nisi bonum." Both of these men were odious creatures in their own right, with one of them far more odious than the other. But the more odious one -- Pat Robertson -- is being adequately vilified elsewhere today, and I had a column all ready to go for the other one anyway, so this (repeat) column is dedicated to the memory of President Ronald Reagan's secretary of the Interior, James Watt. This column was published eight years ago, and thankfully the nation has made great progress since then. It was written to celebrate only the third state (Alaska, after Colorado and Washington) and Washington D.C. legalizing the recreational usage of marijuana. Today, that tally stands at 23 states plus D.C.

Let's make sure we all get this correct. Donald Trump is now technically not a "convicted rapist." He's not a convicted anything, because the verdict handed down against him this week was in civil (not criminal) court. And the jury balked at declaring that Trump had raped E. Jean Carroll, but they did find Trump liable for sexually attacking her and defaming her publicly. To the tune of $5 million. It only took them about three hours to do so, meaning the case was pretty iron-clad to begin with. So Donald Trump is merely the first ex-president to be found liable of being a sexual predator rather than being an actual convicted rapist.

We admit using that subtitle dates us in a way, since we are indeed old enough to remember the popular song of the same name -- but we couldn't resist, since this week started out with Fox News caving at the last possible moment as a civil defamation trial was set to begin against them. First the trial was delayed a day and then came the bombshell news that Fox had settled with Dominion Voting Systems for a jaw-dropping $787.5 million. To state the patently obvious, you don't settle a case you fully expect to win. Fox knew it was in danger of not just losing the case (Dominion had sued for $1.6 billion, a little more than twice what Fox settled for) but having the network's dirty laundry exposed in even more painful fashion than it already had been (through releases of internal communications between executives and network personalities that were already embarrassing enough). Fox was indeed on the run, to the tune of over three-quarters of a billion dollars.

There's a new reality in American politics, and one political party is reaping the benefits of it while the other is trapped in a downward spiral of ever-increasing extremism. Some Republicans are beginning to understand the power of the sleeping giant they have awoken, but there's really no easy way out from the conundrum they have created for themselves. Abortion is going to be a potent political issue for at least the next few elections, and Republicans' only answer so far is to double down, triple down, or quadruple down on forcing the most extreme positions they can come up with on as many of the American people as they possibly can.

The most popular (since it seems to be the most fitting) is that they are the dog who finally caught the car and now don't know what to do with it. Or maybe they've painted themselves into a corner and are now trapped on a shrinking piece of political real estate. But I'm going to start this off with a different one: Republicans riding down a very slippery slope on a toboggan.

Republicans seem to be increasingly fond of using the levers of government -- any levers of government they control -- to get their own way, no matter what. Perhaps this was spurred by Donald Trump's attitudes (and/or lawlessness) or perhaps it is the end result of a gradual Republican slide towards authoritarianism, but whatever the actual cause Republicans are now engaged in rather extraordinary uses of government power to punish those whose political opinions they disagree with. This is a far cry from the traditional Republican stance against "Big Government" it should be noted -- just one more in a long list of previous ideological positions they have completely abandoned in the Trumpian era. They now seem to have settled on: "The era of Big (Republican) Government is at hand!" as a guiding principle.

Most of it is actually going to review the speech that President Joe Biden gave yesterday in Philadelphia, Pennsylvania. Biden went to Philly to introduce his annual budget proposal, which was publicly released just before he spoke.

Apparently, there was a big murder trial down South that culminated this week, but we have to admit that since it wasn't an overtly political case, we just didn't pay much attention to it. Instead, as always, we had our nose to the grindstone of sifting through the week's political news so that you don't have to. In other words: Welcome to another installment of Friday Talking Points!

We're going to start this week with some good news. Not great news, mind you, but pretty good nonetheless. A spate of actual bipartisanship broke out in the Senate this week and with amazing speed (for Congress in general and for the Senate in particular) they came up with proposed legislation that might actually have a chance of passing. Well, passing the Senate at least, since nobody has any clue of what the GOP House will do these days.

Pharmaceutical giant Eli Lilly announced today that they would be slashing their prices for insulin by 70 percent. Think about that for a moment -- a corporation was pricing a product so high that it can cut the price by 70 percent and still make money off of it. That should be seen as nothing short of obscene to the average person. But what is interesting about this announcement is that it seems a combination of public shame and some competition in the marketplace has brought about this change. And that's worth celebrating a little bit, even if the case isn't exactly cut-and-dried.

Senator Dianne Feinstein announced today that she would not be seeking re-election next year. California is going to get an open Senate race for her seat instead. This announcement was anticipated, although nobody really knew what Feinstein was going to decide. But, speaking as a Californian, I am glad she chose to step down gracefully. Indeed, I urged her to do so six years ago.

Senator Feinstein has carved out an impressive legacy for herself, after serving in the Senate since 1992. She broke a lot of glass ceilings and just last year became the longest-serving woman in Senate history. When she first arrived in the Senate, there were two women senators. Now there are 25. She has a lot of accomplishments to show for her time in office as well, although I certainly didn't agree with many of them at the time. Feinstein is a much more centrist (or even right-leaning) Democrat than I would have preferred to have represent me, but I did appreciate at least some of her brave stands.

Last night, President Biden gave (depending on how you look at it) a rousing State Of The Union speech or perhaps the first speech of his re-election campaign. Throughout it all, by my count, he uttered the phrase "Let's finish the job" a whopping 10 times (at the very least... I know I must have missed a few...). That sounds an awful lot like a new campaign slogan to me....

Two years ago today, Joseph Robinette Biden Junior was sworn in as the nation's 46th president. So how is he doing at his job? His approval rating in public opinion polls has generally improved since the midterm elections, hitting numbers he hasn't seen in a year. But those numbers are still south of 45 percent (on average), which is fairly common for a first-term president but certainly nothing to brag about.

Biden has had some notable successes as president, and some notable rocky patches as well. He entered office as the COVID-19 vaccines were becoming widely and freely available, and things seemed rosy on this front for his first year, only to get a lot grimmer as the Omicron strain hit much harder than any of the previous variants of the virus. All of a sudden we weren't done with COVID-19 and life didn't return to normal as expected. But since then, the virus has become almost an afterthought and didn't matter much to voters in the midterms (even though it had been predicted that it would be a major issue).

Biden's legislative accomplishments are more impressive than any president since Lyndon B. Johnson. True, Biden did have a Democratic Senate and House to work with, but both of those had historically-slender majorities -- L.B.J., for instance, had as many as 68 Democratic senators to work with. Biden only had 50 -- including two who loved the media spotlight so much they didn't care if they torpedoed Biden's agenda in major ways. Biden also managed to pass some major bills with bipartisan support, which is almost miraculous, these days.

We were reminded of an old political saying this week: "Only Nixon could go to China." Only a president who was long known as a staunch anti-communist warrior could open up American relations with communist China in the depths of the Cold War, without being painted as some sort of pinko/commie back home. This week's update might read: "Only Biden could pardon weed crimes." Joe Biden, before he became Barack Obama's vice president, had spent much of his life in the Senate being the biggest, baddest drug warrior around. He actually coined the term "drug czar" and worked with the Reagan administration to make the Office of National Drug Control Policy a reality. He's never been pro-legalization in any way, a fact that didn't exactly help him in the 2020 Democratic primaries. But there he was yesterday, taking the first steps away from the War On Weed that any U.S. President has ever taken.

Even though it is a Monday, I find myself in an optimistic mood. Maybe it's just the end of the political Silly Season, but I found myself wondering what would happen if the Democrats truly ran the tables in the midterms and wound up still in control of the House of Representatives and with at least 52 senators in the Senate (so Kyrsten Sinema and Joe Manchin could be politely told to go fly a kite by Chuck Schumer and the rest of the Democrats). What could they get done? What would their agenda look like, with a Democrat in the White House ready to sign whatever passed? I know, I know, it is still the longest of longshots -- Democrats will likely still lose the House even if they manage to expand their majority in the Senate -- but like I said, I'm feeling optimistic, so let's just assume it does somehow come to pass.

The irony is delicious, we cannot deny it. A man who rose to power by leading chants of: "Lock her up!" against his political opponent (for mishandling classified documents -- a man who later signed a law making the offense a felony with up to five years' prison time) is now in the process of being hoist by his own petard. So it's been a rather schadenfreude-y kind of week.

The day many of us thought would never happen is here. Senators Joe Manchin and Kyrsten Sinema finally allowed President Joe Biden and the entire rest of the Democratic Party to actually get some good things done. A budget reconciliation bill has -- almost miraculously and at the last possible second -- passed the United States Senate. The House is on vacation, but they're being forced to come back to Washington anyway for a vote this Friday on the Inflation Reduction Act. It should be on Biden's desk in time for a triumphant signing ceremony by the weekend. Victory is at hand.

That title, of course, is intended as a spoof of what some consider the most overused go-to headline in the Washington punditocracy's toolbox: "Democrats In Disarray!" For once, the absolute opposite seems to be true, and it is so glaringly obvious that even the political press's pooh-bahs have had to admit it (full credit where it is due: we got the title from a Politico article).

President Joe Biden is hoping for a few legislative wins before the midterms. Three bills in particular seem to have a better-than-average chance of success. They're a far cry from the agenda Biden attempted to achieve last year, but having to deal with two corporatist Democratic senators derailed almost all of these lofty ambitions. So Americans will not be getting tuition-free community college, subsidized child care, free preschool, student loan forgiveness, action on climate change, and a whole host of other ideas that would have dramatically improved the lives of hundreds of millions of American citizens. Thanks, Joe Manchin and Kyrsten Sinema, for nothing.

There is no right to privacy specifically enumerated in the United States Constitution or any of its amendments. According to the current Supreme Court, this means that it does not legitimately exist as a foundational right of American citizens. Democrats, for over half a century, have been complacent in relying on previous Supreme Court rulings which did spell out what the implied right to privacy encompassed: the right to marry someone of a different race, the right to purchase and use contraceptives, the right to an abortion, and the right of gay couples to marry (among others). All of those spring from the same right to privacy, but one of them obviously does not exist anymore at the national level.

Hey, kiddies, it's time to play "shadow boxing with Joe Manchin" once again! Yes, his teasing game has begun anew, where Democrats get their hopes up that Senator Manchin will finally agree to pass something -- anything -- from President Joe Biden's agenda, in the hopes of counteracting the predicted coming "red wave" in November's midterm elections. Once again, Manchin is playing it coy, as he is "in negotiations" with Senate Majority Leader Chuck Schumer, but has not actually committed to much of anything. The deadline this time around is the end of July, right before all of Congress disappears into the summer breeze for an entire month. Of course, they're all still on their two-week July 4th vacation this week, so nothing will really happen until next week, which leaves a rather abbreviated window.

Last week, America experienced a racist extremist shooting up a grocery store, in an effort to kill as many Black people as he could. This week, America had to once again watch as innocent schoolchildren age 10 or under were massacred for no reason whatsoever. This is who we are, and it is shameful.

It is not, however, who we want to be. The public wants more and tighter gun safety laws, by an overwhelming margin. But even in the wake of the horrors of yet another slaughter of innocents, most people who follow politics don't expect much of anything to change. No new laws will pass the Senate, or if something does manage to be worked out, it will be weak and watered-down and likely ineffective at stopping such outrages from regularly happening.

Today is a big primary day, and it could perhaps be the most interesting in this year's election calendar. It's not officially "Super Tuesday," but it might at least be considered "Rather Interesting Tuesday." There are multiple close races to watch, there are both ideological battles and personality contests in both parties, and the punditocracy is going to go into high gear afterwards drawing all sorts of conclusions on a nationwide basis (on races that may in fact only be limited to very local issues, or the strengths and weaknesses of individual candidates). So it's going to be a big night, no matter what happens. But everyone should keep in mind that these are just the primaries -- which means a big win for one faction or another tonight might translate into a big loss for the party in November.

Because it is looking like we might wind up with two very passionate and non-conventional "from the people" nominees, one from the left and one from the right. So we will finally get to see a race in a very purple state (which could easily go either way in November) with a contest between a true MAGA and a real progressive, both willing to get down and dirty fighting for what they believe.

It wasn't the biggest or most important political news of the week, we admit, but the one story that definitely caught our attention was the earthquake which reverberated outward from the Democratic National Committee. This Wednesday, the D.N.C.'s Rules and Bylaws Committee voted to upset the early-primary applecart to allow for the possibility of a complete shakeup of the roster of early-voting states (currently: Iowa, New Hampshire, Nevada, South Carolina). For the 2024 presidential race, all the states have now been encouraged to apply for a spot on the early calendar -- with no guarantees for the four states that have previously enjoyed the privilege of going first.

Let's start with some good news this week, because we could all use some, right? Two years ago today Tom Hanks announced to the world he had contracted COVID-19, on the same day that the virus people were then largely calling "the novel coronavirus" was declared a pandemic by the World Health Organization. This was when it all hit home for many -- that this could quite possibly be a very big deal indeed, even though the president of the United States was desperately trying to get the American public to believe otherwise. Salon provides a good rundown of what we all went through next:

This week, President Joe Biden gave his first State Of The Union speech to the United States Congress, to the American people, and to the rest of world. This speech had to be hastily rewritten at the last minute, obviously, due to intervening events. Russia's Vladimir Putin invaded Ukraine at the end of last week, which was obviously a lot more important than any political points or laundry lists of proposed legislation. So the speech got a quick makeover.

Did what happened at the United States Capitol on January 6th, 2021 constitute "legitimate political discourse" or not? That was the question that has divided the Republican Party all week, and may serve to be the one memorable phrase that sums up the difference between those in the GOP who have completely surrendered all their morals and thought processes and attachment to reality to Donald Trump -- and those who have not. Because that's what it all boils down to, really.

At this juncture in time, what was once seen as a radical suggestion seems more and more to now be a very smart course of action. This is far from ideal, since the original plans would have been far, far better... but we are where we are. So perhaps it is time for Democrats in Congress to consider using the budget reconciliation rules in the Senate to achieve only one of their stated objectives. And there is no more pressing concern for the voters than limiting pharmaceutical companies from their continual greed when it comes to setting the price of their wares for the American public. Lowering prescription drug prices via reconciliation would chalk up an enormous political win for Democrats, heading into the midterm campaign season.

Congress seems to be dispensing with all the other high-profile things that were on its calendar for the end of the year, and it's still only the second week in December. This could bode well for the chances of the Build Back Better bill actually passing the Senate on Majority Leader Chuck Schumer's stated timeline ("before Christmas"). Additionally, the bill seems to have acquired two things that will ultimately help both its passage through Congress and its appeal to the public: a deadline and an excellent "poster child" issue.

We are currently in the midst of yet another Democratic failure to properly frame a political issue. This time President Joe Biden and his administration are largely to blame, although other Democrats should really be pushing back on the media's lazy acceptance of a false Republican narrative as well. When the Biden administration announced a new OSHA rule for all private businesses with 100 or more employees, it should have -- from the very start -- pointedly called it a "testing mandate." Because that is what it is, plain and simple. It is a requirement that all employees get tested once a week for the COVID-19 virus. And that's all it is -- that is the only thing it actually mandates.

I'm not usually that a big fan of (or any kind of rosy-tinted optimist about) legislative compromises. Or incrementalism, in general. But the deal Senate Majority Leader Chuck Schumer announced today on prescription drug relief doesn't actually sound all that bad. It certainly has its drawbacks -- parts of it are incredibly limited, for one -- but it also will fundamentally change things to the point where improving upon the basic idea will only require a little future number-tweaking. Which seems good enough, at this point (and with this Congress). So I have to say: this is not too bad for "half a loaf."

The fastest and easiest way out of the COVID-19 pandemic -- and back to a fully-functioning economy -- is to get as many people as possible vaccinated. That was Joe Biden's message today, in a speech he gave promoting support for vaccine mandates. It was his strongest statement on the subject to date, and he tied it at every step to getting both daily life and the economy fully back to normal.

Biden's timing is pretty good, because many vaccine mandates which had been announced a month or so ago (back at the height of the Delta spike) are finally taking effect. People are getting fired because of their continuing refusal to get vaccinated. But, as Biden pointed out, while most of the news stories center around the few hundred who get fired, they mostly ignore the tens (or even hundreds) of thousands of people who not only keep their jobs, but can now do so more safely. Which was Biden's core message: vaccine mandates work. They save lives, in the end.

The mainstream media, as usual, is mostly presenting the power struggle taking place right now within the Democratic Party in a rather slanted way. The fight, we are told, is a fairly equal one between "moderates" or (as is becoming more in vogue recently) "centrists" and the progressives. The progressives are usually painted as the radicals, while the "centrists" are seen as those cautioning moderation and compromise. Virtually none of this is true, however. What is really going on is the old-guard "New Democrats" are being forced to confront the reality that it is no longer the 1990s, and their particular brand of "Wall Street-friendly" Democratic politics is not only seriously on the wane but has now been almost totally eclipsed. Senator Bernie Sanders was at the vanguard of effecting this drastic shift, but it is almost complete. And the old guard is none too happy about it, as they cling to the remaining leverage they still have.

This was never going to be a good week for President Joe Biden. The ongoing crisis in Afghanistan pretty much guaranteed that. But although the week started out with signs of optimism -- more and more people being airlifted out of Kabul, to top 100,000 by week's end -- it ended in disaster. A suicide bomber exploded his vest right at the gate to the airport, which killed at least 13 American servicemembers and over 100 Afghans (as of this writing the official death toll for Afghans had hit 169). So while this week could have been perhaps tense but slightly optimistic, by week's end that was no longer possible. It was disastrous; there's just no other way to put it. One grim way to measure it is Biden has now made his first addition to the number he always carries around with him in his jacket pocket -- the number of fallen U.S. servicemembers from both Iraq and Afghanistan.

In all the discussion over how to convince unvaccinated Americans to get vaccinated, I have noticed one suggestion popping up repeatedly -- but always down in the comments, never proposed by any pundit or politician (that I am aware of, at least). It's a simple and elegant answer to the problem, although I have no idea whether it could actually be legally implemented or not. Or if it should, for that matter. The idea? If you choose not to get vaccinated, then your health insurance company should inform you that you will not be covered if you get it and are hospitalized. Your insurance would still work for all other ailments and treatments, but not for COVID-19.

There were two interesting developments in the congressional sausage-making process this week, both of which Democrats should immediately adopt as their main messages for the next week or so.

The first was that Senators Bernie Sanders and Mark Warner announced they had come to a compromise on the reconciliation bill which will fund the lion's share of President Joe Biden's economic agenda. They settled on a total figure of $3.5 trillion in new spending, which is far less than Bernie's original goal of $6 trillion (just for this bill alone), but also far more than the opening bid of the fiscally-conservative Democrats, which was in the $1.5 to $2 trillion range. It also will mean that Biden got the exact total he asked for in his "three-legged stool" of economic legislation. His first big legislative achievement (the American Rescue Plan) spent $1.9 trillion, and the bipartisan infrastructure deal represents $0.6 trillion more, which will mean a grand total of $6 trillion for all three -- which is exactly what Biden asked for in the first place.

Senate Majority Leader Chuck Schumer announced this week he will be moving legislation to the floor of the Senate to legalize marijuana at the federal level. This is an important milestone (even if the measure fails), since such legislation has never had leadership support in the Senate before. The House has passed similar bills already, knowing full well they were all going to die in the Senate. But with Schumer on board, the chances that the federal War On Weed could end have improved considerably.

Although few are pointing it out today, Senator Bernie Sanders is truly the man of the hour in the Democratic Party right now. Much faster than anyone expected (myself included), Senate Majority Leader Chuck Schumer announced last night that a deal had been struck within the Democratic caucus over the reconciliation bill that Bernie Sanders is in charge of writing (as chair of the Senate's budget committee). This deal was principally negotiated between Sanders and Senator Mark Warner, who represented the penny-pinching faction within the Democratic Party. But even with this necessary trimming, what was just announced is simply breathtaking in its scope and reach.

Can Democrats still be bold? We are perhaps on the brink of finding that out. Joe Biden campaigned as a total moderate, but has been sort of thrust into a historical moment when boldness might actually be possible -- and be rewarded. By the time he got into office, Biden had realized this and was already talking about being a "transformational" president rather than just a moderate caretaker.

The COVID-19 pandemic was what set the stage for all this bold action, and Biden has done an admirable job of delivering on his promises on this front. But the rest of his economic agenda is now on the verge of becoming reality as well, and if the lion's share of it passes, Biden will indeed bask in comparisons to F.D.R. and L.B.J.

President Biden is currently in Europe, in the midst of his first trip abroad since he took office. So the folks at Pew Research decided it was a good time to see how America is now viewed by the rest of the world (or the countries with advanced economies that were surveyed, at any rate). The answers are exactly what you'd expect them to be -- America's standing in the world has dramatically improved, now that a sane adult is in charge of the country once again (instead of an unstable and temperamental toddler).

President Joe Biden announced a new goal for his administration today: getting 70 percent of Americans vaccinated at least once before the Fourth of July. That's a pretty high number, even though we've got two whole months to go. But it is an interesting one to pick, since it is the low end of the estimate for what the country will need to achieve "herd immunity" (others put the number higher, as high as 80 or even 85 percent). So it is without doubt a worthy and admirable goal to shoot for.

President Joe Biden just had a pretty good week. And next week's going to be even better for him. Especially considering how far we've come since this time exactly one year ago.

In the past week alone, Biden and his administration chalked up the following achievements or milestones:

Biden has already reached his (doubled!) goal of 200 million vaccine shots into people's arms in his first 100 days in office -- a week early.

Over 41 percent of the American population has been vaccinated at least once, including over 51 percent of all those currently eligible (age 16 and up).

The average number of new infections has actually started to come down once again, and is once again lower than the peak of the second wave. It is still too high, but at least it is heading in the right direction once again. The average deaths per day seems to have plateaued at just below 750 -- again, too high, but a lot better than the peak of almost 3,500 deaths per day.

Starting today, any American age 16 or older should be able to schedule an appointment to get their first COVID-19 vaccine shot. President Joe Biden originally set a goal of the first of May for this milestone, but was able to move it up a few weeks due to the overwhelming success of his vaccination program so far. Biden's first 100 days won't be up until next week, but he has already met or is on track to meet every pandemic-response goal he set for his administration -- including getting an astounding 200 million shots into people's arms in his first 100 days. This was actually a doubling of Biden's original stated goal, but he'll still hit the increased target he set for himself. It seems probable, at this point, that Biden's first year in office will largely be judged on the overall success America ultimately sees in the fight against the deadly disease. And up until this point, Biden's been doing a pretty stellar job.

So, let's see... Joe Biden has been in office for over two months, and the only scandal to emerge from the White House so far has been from First Dog Major Biden. While over in Republicanland, Representative Matt Gaetz reportedly not only had sex with a 17-year-old minor while using the illegal drug ecstasy, but he also paid her online (possibly through a setup on a "sugar daddy" dating site); and not only took nude photos of all his conquests (which apparently included a naked hula-hooping video), but actively shared them with other congressmen on the floor of the House of Representatives. He's now under federal investigation for possible sex trafficking. But he has retained his seat on all his House committees, since Republicans are now noticeably more in favor of "due process" than they are whenever Democrats are in trouble. So could someone please remind us, once again, exactly which party is supposed to be the "party of family values"? After all, they used to brag about it so loudly....

Joe Biden will be giving his first press conference tomorrow. The political press is already annoyed at him, for making them wait so long (longer than any other modern president) for this first formal press conference. The American people aren't as obsessive about this sort of thing, but what it means is that the journalists will all (as usual) be playing to the cameras even more than the president, trying to create the ultimate and defining "gotcha" moment for the glory of their network (and for themselves). That's how this game is played, or at least how it is played now. The only way to change this rather silly dynamic would be to ban television cameras and just release a typed transcript afterwards -- but that's never going to happen.

Before we get to the other events of the week, we have to comment on one particular political fight that is heating up to a surprising degree. Both sides of the aisle see this fight in fairly existential terms, so it's an important one across the board. But what is rather surprising is that, this time around, Democrats seem to be ready and willing to fight for their beliefs, they appear to have both the much higher moral ground and the support of the public, and they also have a devastating bumpersticker slogan for what they are fighting so hard to prevent. For Democrats, that (sadly) is rather surprising, all around. In bumpersticker terms, the Democrats' position might be summed up as: "Stop Jim Crow 2.0!"

Bad puns aside, though, the dereliction of duty shown by President Donald Trump this week should stun us all. It doesn't, of course, because: he's been derelict on so many duties over the past four years already; he's been especially out to lunch on the coronavirus pandemic; and most people are paying more attention to his extended tantrum about losing the election to Joe Biden. But we should be paying a lot closer attention to what Trump is failing to do right now -- and our guess is that we will, very soon now.

The second (and final) presidential debate tonight was as different from the first as it could possibly be. That will likely be the biggest takeaway for both the press and the public. President Donald Trump -- for the most part -- actually behaved himself and didn't try to dominate every single minute. Joe Biden debated the way he really wanted to in the first debate. It was, in a word, normal. Which is why this will be the big headline tomorrow, because whenever Trump does anything even halfway normal, it is big news.

It seems that it is now time to ask a very strange question: Is Donald Trump actually trying to lose the election?

As astounding a question that is, there are really only two answers to it: yes or no. Either Trump is intentionally torpedoing his chances of re-election, or he is just trying to re-run his 2016 playbook in the hopes that it'll produce the same miraculous victory for him. But either way, what is becoming more and move evident is that President Donald Trump is currently losing. Bigly.

Olivia Troye used to be a high-level staffer for Vice President Mike Pence, and she worked closely with him on the coronavirus task force which he led. She recently quit in disgust and went public this week with her support for Joe Biden (in yet another "Republican Voters Against Trump" video). The most damning thing she had to say about the president was the following:

It has been three weeks since we've done this, since for the past two Fridays we were still writing up our notes on the Democratic and Republican National Conventions. Now that all that hoopla is over, we can return once again to our usual Friday Talking Points format.

When reading other reviews of the Republican National Convention today, many seemed to me to be making the mistake of proclaiming: "Trump is preaching to the choir, he's only interested in firing up his base." There is indeed a lot of this sort of thing, but there is also a sustained effort at pandering to distinct voter demographics where Trump is either performing weakly or worse. The two efforts -- fire up the base and reach out to possible "persuadable" voters -- set up another disjointed disconnect of epic proportions, to be sure, but as Trump says, it is what it is.

Today's one of those days when I had a subject already in mind for a column, but then read a few other columns that essentially already said what I was going to say (and in at least one case, said it much better than I could have). Fortunately, a second subject also popped up while reading the news today. So what I'm going to do is provide a few longish excerpts from the articles I read on the first subject at the end of this column, as a sort of "imagine the column Chris would have written" mental exercise (I even had a theme song in mind...), complete with the links to the original articles.

Instead, I'm going to write about weed. Weed voters, in particular. Now, any longtime reader of this column knows that I've been banging this particular drum for a very long time -- in particular, the fact that marijuana legalization is a political issue ripe for support from one of the major political parties. Sadly, both parties continue to shy away from it, although the Democrats have done a lot more "evolving" on the issue than most Republicans. Some Democrats, I should say, because not everyone's on board yet. I didn't notice this at the time, but here's a rundown of what happened to the party's official platform document this time around:
