Remember the last government shutdown? It wasn't that long ago. It was, in fact, the longest such shutdown in American history. The Democrats refused to help Republicans pass a budget because they were making a principled stand on an important political issue. Now that we may be days away from another government shutdown, it saddens me to say that the cause that was worth forcing the previous shutdown seems to have completely fallen off not just the Democrats' radar, but everyone else's, too. And that is a shame, because it will bring continued hardship to tens of millions of Americans.

Two stories dominated the political headlines this week: Texas Democrats fleeing the state to halt the Republican-dominated legislature's efforts to redraw their U.S. House district lines to hand Republicans five more safe seats, and Donald Trump letting incredibly high tariffs begin against over 90 countries worldwide.

We'll get to them in a moment, but what's more interesting is the dog that didn't bark today. Russia was supposed to have a "10-day deadline" to end its invasion of Ukraine, and steep tariffs were supposed to be slapped on them if Vladimir Putin hadn't manage to do so by today. However, nary a headline is talking about the tariffs that were supposed to appear, because once again Putin played Trump like a violin.

I've written about this subject before, where I used the phrase: "Be careful what you wish for" in the opening paragraph, so I thought I'd just use it as today's headline. Previously, I had written about an effort in the Senate to introduce a bill that would remove the ability of federal judges below the level of the Supreme Court to issue nationwide (or "universal") injunctions which banned government behavior while a case was being litigated. Here's how Republican Senator Josh Hawley explained the need for the bill he intended to introduce:

What needs to happen is one of two things: Either the Supreme Court needs to intervene and make clear there's only one court that can issue rules for the whole country, that's the Supreme Court, that's why we only have one of them. [O]r, if they won't do that, Congress needs to legislate and make clear that district courts do not have the ability to issue these kinds of injunctions.

Today, the issue was indeed argued before the Supreme Court. And the conservatives on the court seemed open to perhaps limiting or removing the ability of lower-court judges to issue such universal injunctions. To which I again say: Be careful what you wish for.

Judicial independence is under attack in America right now. The president and his supporters are calling for impeaching judges -- not for any "high crimes and misdemeanors," but instead for issuing rulings they don't like. And today, in a remarkable "be careful what you wish for" moment, a Republican senator has announced he will introduce a bill to restrict federal district judges from making any rulings that apply nationwide. This is somewhat amusing, seeing as how Republicans use this tactic all the time when there is a Democrat in the White House.

Since it is Thanksgiving week, I am going to write a positive article today about Donald Trump (well, semi-positive, at any rate...).

Of course, there is indeed a whole universe of negative aspects of having Trump as president again, but even I have to admit that Trump has had a few positive effects on the Republican Party -- mostly by his insistence that they blindly follow him in all things. This has meant the party as a whole has had to largely accept some of Trump's very non-traditional stances on issues (non-traditional for conservatives or Republicans, that is). Trump, unlike many of the ideologues who used to set the party's direction and policy objectives, has the ability to occasionally spot an issue where the GOP's traditional position is so unpopular that it winds up hurting them at the ballot box. Two of these issues in particular stand out. Trump can't truly be said to be "on the right side" of either of these issues, and his objection to the more-extreme positions the Republicans traditionally have taken is rather thin and transactional. But it's better than where the party was headed without Trump, so he at least deserves partial credit for how he's changed the party's orthodoxy. And then finally, Trump has now made one cabinet pick that even plenty of Democrats will likely get behind in the Senate, when it comes time for their confirmation vote.

Do Democrats still have a "big tent" party, or have they now morphed to being a "small tent" party by insisting on too many must-pass litmus tests? That is a question Democrats should really be asking themselves now, after suffering a humiliating election defeat. That's the traditional way to put it, but at the risk of using an offensive term, what they really need to decide is whether they're going to allow what might be called "Cafeteria Democrats" to exist peacefully within their party or not.

The final week of the 2024 presidential campaign was reduced -- quite literally -- to "trash talk." This is perhaps a fitting end for this contest, one might think.

But among all the frenzy surrounding who called whom "garbage" this week, Vice President Kamala Harris delivered her closing pitch to voters from the same spot Donald Trump incited a mob to go attack the United States Capitol four years ago. From the Ellipse, with the White House in the background, Harris spoke of the differences between her and Trump, and made her closing argument for why Americans should vote for her rather than him.

Today seems like a good day to write an optimistic column. I was inspired to do so by reading a different optimistic column, in today's New York Times (to give full credit for my outburst of rosy-tinted cheerfulness). The article, by Jonathan Alter, is titled: "What If Democrats Win The White House And Congress On Tuesday?" It does begin by admitting that this all may be a "pipe dream," but it lays out what Kamala Harris and a Democratic Congress (with control of both houses) might be able to accomplish.

Since we are less than three weeks away from the election, we are going to diverge from our normal Friday Talking Points format today.

Instead of brief talking points at the end, instead we tried to make the case against electing Donald Trump in the most effective ways we could think up. But when we got done, we realized that this extended rant also served as a good round-up of the week's political news. Sure, there were a few other things going on in politics, but at this point we are so focused on the campaign and the election that anything else is really just a distraction, this close to Election Day.

Election Day is still over two weeks away, so this might seem a little premature, but I thought I'd write today about the key races I will be watching as the night of November 5th unfolds. Because while the main event will be the presidential election, as we saw last time around these things can drag on for not just hours but days, and in the meantime there are plenty of other races worth paying attention to.

The Republican Party is now allergic to the truth. This is what comes from the entire party following, with slavish devotion, a man who lies as easily as he breathes. When Donald Trump was president, the Washington Post counted up over 30,000 lies he told -- an average of 21 per day. Since then, Trump has successfully purged the party of pretty much everyone who has ever disagreed with him on any of them. All that are left are those that are willing to buy into the mindset that reality is what Donald Trump says it is, period. Democrats have been wishing for a while that the Republicans would all wake up one day and return to sanity, but now it's more of a wish that they return to some sort of objective reality -- rather than the Trumpian fantasyland they all now inhabit.

We are entering the homestretch of the presidential election, and who is going to win is anybody's guess. Polling is no real help since it shows many battleground states either perfectly tied or within a point or two. Both candidates are out there campaigning hard, but neither has a clear edge over the other one. It's going to go right down to the wire, that's about the only thing which seems certain at this point.

There were two major events in the presidential race this week, but we are left wondering if either one of them is going to make much of a difference one way or the other. Perhaps we're getting a bit jaded by it all....

The first was the one-and-only vice-presidential debate, held on CBS this Tuesday. Republican JD Vance faced off with Democrat Tim Walz, and it was watched by 43 million people as it aired. The second was the public release of a document prosecutor Jack Smith had previously filed with the court in Donald Trump's January 6th case. It laid out Smith's basic case, in great detail (165 pages' worth).

In a normal campaign season, either one of these would have been impactful, perhaps shifting the polling in significant ways. But in our hunkered-down tribalistic politics, the needle barely quivered. Maybe we're all getting a bit jaded?

There were two other rather large events that could affect politics this week: the massive damage Hurricane Helene did -- especially in the Appalachian Mountain region -- and an East Coast dockworkers' strike. The first shouldn't really have been political, and the second was over almost before anyone was aware it was happening.

After what were arguably the two most consequential presidential debates since at least the Nixon-Kennedy debate (which launched the era of televised debates), last night's vice-presidential debate was pretty... well, normal. It harkened back to the age before Donald Trump entered the political scene, when two candidates would debate political issues without getting overly vicious or personal in their attacks, in the hopes of presenting themselves to the public as acceptable leaders of the country. That was really the striking takeaway from last night -- a return to normalcy, in the midst of yet another Trumpian rollercoaster of a presidential campaign. In fact, this normalcy stuck out as completely abnormal to the bizarre political landscape Trump has dragged us all into for the past nine years.

Donald Trump got his start in politics by infamously pushing the "birtherism" lie about Barack Obama. Now he's pushing what might be called a "burgerism" lie about Kamala Harris -- that she somehow just made up the fact that she worked at McDonald's back when she was a student. It's all a measure of the desperation Trump finds himself now wallowing in, since to date none of his attacks against Harris have even come close to landing.

In the political debate over abortion, people like Donald Trump (and plenty of others) like to use a dodge, when talking about what they support. They say they are in favor of three exceptions to abortion bans: rape, incest, and "the life of the mother." But what does that last one mean, on a practical basis? It means needless suffering, pain, risk, and in some cases the actual death of the mother -- all because doctors are scared of being thrown in jail for providing necessary medical services on a timely basis. This is beyond tragic and completely unnecessary, and yet it is no mere hypothetical -- it is happening right here in the United States of America in the twenty-first century.

This week, millions of Americans tuned in to politics only to make an astonishing discovery: Donald Trump is still exactly who he always was! He opens his mouth, and lies and crazy talk pour forth. Same as it ever was... what a surprise!

Now, normal people can be excused for being surprised that Trump is still Trump. Most people have lives to lead and plenty of other things to do, so they simply don't pay much attention to politics. But tens of millions of them made the time this week to tune in to the first debate between Donald Trump and Kamala Harris. And it was like going to a family Thanksgiving dinner and once again having to put up with your crazy uncle -- because you had somehow forgotten just how bad he truly was. And still is.

Pundits are using words like "eviscerated" and "humiliated" to describe how impressive Harris's takedown of Trump truly was last night. For the first time in his political career, Donald Trump was absolutely dominated -- live, on screen, for all of America to see.

Traditionally, Labor Day is the kickoff to the "real campaign season." This implies that none of what has gone before really made much of a difference, and that the American people will now give each of the candidates a fresh look as people slowly turn their focus to politics after the summer season is done.

Maybe that was true once, but quite obviously we've been in the midst of the general-election campaign season for most of this year already. There was no drama or mystery about who would become the major parties' nominees -- Donald Trump and President Joe Biden had the primaries wrapped up before they even began. And then the most dramatic event of the general election campaign happened midsummer, as Biden decided to end his candidacy (after a disastrous debate performance with Donald Trump). In other words, plenty has already happened this election season, and so we've got to look at the remaining two months as nothing more than the homestretch.

Two Tuesdays from now, the two major presidential candidates are set to have a debate. At this point it seems more likely than not that both Kamala Harris and Donald Trump will actually show up, although the details are still being hashed out between the two camps. The biggest sticking point seems to be whether the microphones will be live throughout the entire evening or whether they will be muted when the other candidate speaks. What is rather mystifying is that the positions have been reversed in this squabble -- it is Harris who is arguing for live microphones, while Trump wants them muted. Which leaves me to wonder whether we'll get a real debate or whether it will devolve into a shouting match.

Over its first three days, the Democratic National Convention kept building on one overriding theme: joy. Or, as Alexandria Ocasio-Cortez explained to Stephen Colbert last night, for Democrats it was "the rebirth of hope." I almost expected Beethoven's Ode To Joy to be played at some point, but I guess the various DJs didn't have a copy. A far different Alex -- the main character in A Clockwork Orange -- would have been seriously disappointed by this omission, since (as he put it) it would have added: "all the banging and creeching about Joy Joy Joy Joy." The lack of "Ludwig Van" aside, though, it certainly was a joyful event for the first three nights.

But hey, all that was a long time ago, and people have mostly forgotten how Trump denigrated an authentic war hero (John McCain) in 2015, so Vance just kept trying.

Two more states -- Missouri and Arizona -- have now certified the signatures required to place abortion rights on their ballots in November. This brings the total for this election cycle up to eight states, although the possibility of the ballot measures having a meaningful impact on the other races on the ballot realistically only exists in three of them. So far, abortion rights have an unbroken 7-0 record of winning, even in some very red states, so it will be interesting to see if that continues or not. But beyond electoral geekiness, if any of them win it will be a victory for women's rights and freedom over government interference in the most personal of medical decisions.

In a little over two weeks, the Democratic Party has gone from "Biden/Harris" to "Harris/Walz," as their ticket has now been completed with Vice President Kamala Harris's selection of Minnesota Governor Tim Walz to be her running mate. But what's more astonishing than the lightning-fast schedule for all this unfolding is how utterly seamless it has all been. The party quickly unified behind Harris after President Joe Biden announced he was dropping his campaign, and from all indications today it looks like the party will further unify around the choice of Walz to round the ticket out. There are no simmering "Hillary Clinton supporters versus Bernie Bros" bad feelings tearing the party apart; instead, all the various factions seem content with the way things have worked out. That is an incredible accomplishment, for Democrats. Both progressives and centrists lined up to endorse Walz after this morning's announcement, with no hesitation.

Last week, we wrote our third Friday Talking Points column in a row that dispensed with our usual format and was solely devoted to angst and calling on President Joe Biden to drop out of the race. This week, we are happy to say, things have changed for the better. And that's putting it mildly!

Vice President Kamala Harris is now the presumptive Democratic Party presidential nominee. Joe Biden is now officially (through his own decision) a lame duck. And Democrats by the millions have been astounded that they are now feeling genuine hope and actual enthusiasm about an election that was shaping up to be pretty grim indeed.

What a week it has been....

Last Thursday night, America watched Donald Trump accept his party's presidential nomination at the Republican National Convention. Republicans had owned the news cycle all week long as they put on their quadrennial extravaganza, topped off with a full hour and a half of Trump rambling on about this, that, and the other. Traditionally, presidential candidates get a "convention bump" from all the free media, so perhaps Team Trump was looking forward to skating for the upcoming week, and just riding out the wave that the convention brought.

Vice President Kamala Harris is now the presumptive presidential nominee of the Democratic Party. She clinched this status yesterday, only a little more than 24 hours after President Joe Biden announced he would be ending his re-election bid. Convention delegates in state after state quickly met and then proudly announced they were unanimously behind Harris. This completely precluded the idea of a "mini-primary" (which many pundits had been hoping for), since no other viable Democrat even came forward to challenge Harris. So with remarkable speed, the Democratic Party has now unified behind Harris as their standard-bearer. Within the same 24-hour period, a jaw-dropping $81 million was donated to her campaign (the total is now well over $100 million). People are already volunteering to work for the campaign by the tens of thousands. Numbers aside, though, Harris has already achieved a remarkable feat -- she has excited voters.

The biggest political news of the week by far was Hunter Biden being convicted in record time on all three felony gun charges lodged against him. The jury spent only about three hours before returning these verdicts, which completely undercut the narrative Donald Trump has been spouting about how the justice system is "two-tiered" -- by which he means: "weaponized against Republicans while Democrats get a free pass." Kind of hard to make that argument when the president's own son just got convicted of felonies and is facing up to ten years in prison.

There was significant news today on reproductive rights, from two separate directions. The Supreme Court unanimously (!) overturned a case that challenged the F.D.A.'s approval of mifepristone, one of the two most commonly used abortion pills in the country. The unanimity was possible because the high court essentially punted on the legal question and instead ruled that the plaintiffs had no legal standing to bring their case. Meanwhile, in the Senate, a bill to create a federal right to in-vitro fertilization failed, mostly on party lines. Last week a bill that would have given federal protections to contraceptives also failed. Both will be used in campaign advertising by Democrats to paint Republicans as being against both contraception rights and I.V.F.

It is supposed to be a metaphor, of course. It's supposed to be said when a person or company is about to try out a new idea or product: "Let's run it up the flagpole and see who salutes." In other words: "Let's try it out and see how it goes -- it might wind up being popular." But this week the saying sprang to mind in a much more literal fashion, since Supreme Court Justice Samuel Alito already knew who was going to salute the two very real insurrectionist-themed flags that got run up the flagpoles in front of both his house and his vacation home. Flying them after the January 6th attack on the U.S. Capitol signified support for those who had besieged the building, plain and simple. It was a rather treasonous thing to do, when you get right down to it. Which Alito fully knew (or should have, at any rate).

With most of the "must-pass" legislation already out of the way for this year, both the House and the Senate are now planning a series of what are commonly called "messaging bills." These are bills that have one main intent -- not to pass the other house of Congress and become law, but instead to "send a message" to the voters. It's a polite way of saying "generating partisan talking points to use on the campaign trial."

Presidential debate announcements, Michael Cohen testifying, and The Jerry Springer Show breaking out in a House committee -- it's been an eventful political week all around, folks!

But we have to begin today with a very sobering piece of data, just to put everything in some perspective. We (rather obviously) personally live and breathe the political scene, and it is a fair assumption that anyone who regularly reads this column all the way to the end (a weekly marathon, 'tis true...) is also pretty plugged in to the follies of the everyday political landscape as well. We all pay attention, in other words. Not just to the large and meaningful events, but also to the small and amusing. But it cannot be repeated enough: this is not exactly normal. Most Americans just don't pay all that much attention to politics. Like, at all.

Today my eyes have turned towards Maryland, and not just to watch the video clips of the explosive demolition of part of the Francis Scott Key Bridge (which was indeed fascinating to see). The plans to fully reopen the port seem to be moving forward on schedule, which is doubtlessly some very welcome news for both the city and the whole state. But tonight I'll be watching Maryland for a different reason, since they are holding their primary election today.

The big race worth watching here is who will win the Democratic primary for an open Senate seat. The Republican primary became a foregone conclusion with the entry of the state's former governor, Larry Hogan. Which Democrat will face him could be crucial to control of the Senate this November, though.

It's always impossible to know, when Donald Trump settles on a new worldview, whether he actually believes it is reality, or whether he's fully conscious of gaslighting everyone with a made-up story that just conveniently always makes himself out to be the good guy (who never does anything wrong). Gaslighting seems the obvious answer, but Trump seems to buy into his own fantasies so deeply (see: the 2020 election results) that you have to wonder how attached he is to the reality that everyone else lives in. But we'll just leave any diagnosis to trained mental health professionals, because whether he actually believes his gaslighting or not is kind of irrelevant to the rest of us. And in the past few months, Trump has developed a new mental construct where the issue of abortion is, as he put it in a recent interview, "not that big of an issue" any more.

This week was supposed to begin (for us, since we measure weeks from Friday to Friday) with a Donald Trump rally in North Carolina last Saturday. After being cooped up in a courtroom all week listening to the lawyers haggle over jury selection, Trump was going to hit the campaign trail again to bask in the glow of adulation from his MAGA faithful (even the Proud Boys showed up!). That was the plan, at any rate.

But then the rally had to be cancelled at the last minute...

[...wait for it...]

...due to stormy weather.

[pause for rimshot]

Arizona Republicans (a few of them, at any rate) just pushed back against the extremist forced-birth movement within their party, in a big way. The lower house in the Arizona legislature just passed a measure that will repeal the state's Draconian abortion law. This is the law that was written during the Civil War and only had one exception in it: abortions were permitted to save the life of the mother. Rape and incest victims weren't included. Abortions were prohibited -- complete with a jail sentence for the doctor -- from Week Zero. This is precisely the type of law the most extreme forced-birthers want to see nationwide, it bears mentioning. If your position is that abortion equals murder, then there is no justification for any abortion that isn't done to save the mother's life, period. So to have Republicans cast the deciding votes to repeal such a measure is a very big deal, because it is the first time since the Dobbs decision was handed down that a Republican-run legislature has voted to relax forced-birth laws.

So far the biggest news (other than today's horrific events) has been that Trump can't seem to stop falling asleep in the courtroom. He drifts off, closes his eyes, his head slumps down on his chest, his mouth goes slack... and then eventually he snaps back awake. It hasn't happened every day, but one does wonder if he's going to be this lethargic when the actual case gets rolling. Jury selection is a repetitive process than can get monotonous at times, but hearing the case presented by both the prosecution and the defense might be a little more interesting to Trump, so we'll just have to see.

I was reminded recently (by a reader who tweeted it to me) that the "People v. Donald Trump" trial which began today is not so much: "the porn-star hush-money case," but rather more properly: "the 2016 election-interference case." Because when all the tawdry details are stripped away (so to speak... ahem...) this is indeed what remains: Trump gamed the system to suppress bad news about him which could have influenced how people voted. And since a relative handful of votes in a few key swing states provided him with his victory, if he hadn't done so things could easily have gone the other way. To put it differently, we might now be in a frenzy of horserace speculation about which Democratic candidate would be the nominee to succeed President Hillary Clinton, at the end of her second term.

If Democrats have their way, the 2024 election will be a one-issue election for many voters (enough to win, hopefully). And conservative Republicans just keep making it easier and easier for that to actually happen.

In the half-century that Roe v. Wade was the law of the land, Republicans made a lot of political hay out of being what they called "pro-life," but what is now more accurately referred to as "forced-birth." They want to force every woman who ever gets pregnant -- no matter the circumstances, no matter the consequences -- to give birth, no matter what. American women (and men, it should be noted) do not support these radical restrictions of their rights. And they're now going to get to vote on it, in the clearest way since Roe was overturned. The 2024 election may well go down in history as being "the abortion election," to put this another way.

We are still over half a year away from the 2024 election, so it would be premature to say: "This is the issue is that the election will all be about" (since anything could happen in the meantime which could eclipse all the biggest current issues). But it is looking like abortion rights are going to be a major part of it, at the very least. The fallout from the Supreme Court's Dobbs decision continues -- in statehouses, in ballot measures, and in court decisions. Republicans continue to learn that the most Draconian abortion laws are incredibly unpopular, and they scramble to figure out some way to deal with it all. Democrats are out there championing "freedom" and "protecting your rights" and "get the government out of your private business," which are all very potent arguments in general and which all seem to be resonating with the voters on abortion.

Yesterday, the Arizona supreme court dropped a bombshell into the political fray. It ruled that an abortion law first written in 1864 was still valid and constitutional and would soon go back into effect. This law, written during the Civil War era, completely bans abortion with only one exception. Here is the relevant text of the original, from the section criminalizing poisoning (and "just after the section banning duels"):

Last week, Donald Trump promised he'd be making a statement "next week" which would lay out his position on abortion laws. Astoundingly, he actually followed through today by releasing a video on his pet social media network. I say "astoundingly" because Trump has promised to unveil new policies "next week" throughout his entire political career, but he seldom (if ever) actually does so. As Little Orphan Annie might say, "next week" is always conveniently a week away, for Trump.

So when a 4.8 temblor hit New Jersey, we certainly could sympathize. Here was the tweet that the "USGS Earthquakes" account put out this morning:

Up until the advent of Donald Trump in American politics, there had been a pervasive attitude among many politicians that there were certain norms and traditions that had been established and long-followed, so there was no need to codify any of them into actual laws. One of these was the belief among Democrats that Roe v. Wade was settled law and that as time went on it had become increasingly impossible to even consider that it would ever be overturned. The judiciary had staked out certain rights, so there was no need for Congress to enact the same rights -- doing so would actually be redundant.

The Florida supreme court just sent a very mixed message on abortion rights. In two decisions released today, the high court will allow a very strict abortion ban to take effect, but they also decided to allow an abortion-rights ballot initiative (which would enshrine the right to an abortion in the state's constitution) to appear on this November's ballot. Conservatives in the state government had been hoping that the ballot measure would just get tossed out, but the court allowed it to go forward. As I said, this was a very mixed message from the court.

For once, big things are actually happening in Congress. No, really!

As we write this, the House has passed the final budget bill for this fiscal year (by a vote of 286-134) and sent it over to the Senate. The Senate may pass it tonight, if senators like Rand Paul can restrain their natural urge to be total [insert favorite plural derogatory expletive here]. If they do throw a monkey wrench into the works, we could have a very short-lived partial government shutdown, but if it gets resolved before the weekend is over then it won't do much damage at all. Either way, the bill's got the votes to pass the Senate, so it's now only a matter of time until President Joe Biden can sign it and the budget that was supposed to be in place on the first of October last year will finally be finished.

There is an effort underway to reform the federal judiciary in one particular aspect -- but it will not completely end the practice which spurred the reform, and already Republicans in Congress are pushing back by declaring that new laws must be passed instead of just a new rule from the judiciary. This isn't too surprising, since conservatives have had much better luck using the tactic to achieve the outcomes they desire in federal courts.

The practice is known as: "forum-shopping," or even more colloquially: "judge-shopping." If an organization wants to attack a law or policy in an attempt to get it declared unconstitutional and overturned, they seek out a plaintiff who happens to live in a judicial division that all but guarantees they'll get a very friendly federal judge to hear their case. This can lead to injunctions being handed down that affect not only the people in that district, but in the entire state or even the entire country. Rather than taking their chances with some random judge, one is pre-selected before filing the suit -- a judge who can be counted on to rule for their side.

During her campaign for president, Nikki Haley has been trying to have it both ways on the issue of abortion by tailoring the way she speaks about it to try to be everything to everybody. She speaks of bringing everyone together to achieve some sort of "consensus" -- which seems downright impossible given the positions staked out by both sides of the debate. And, true to form, ever since the Alabama supreme court tossed in vitro fertilization into the political arena, Haley has likewise been trying to have it both ways on the legal questions that have arisen. Except that on this issue, Haley has a more personal stake, having had her own children using I.V.F. So when she was interviewed on Meet The Press this weekend, host Kristen Welker tried to pin Haley down on her position. What she got from Haley was complete incoherence. Haley contradicted herself repeatedly, coming down on every possible side of the issue at once. To say she was talking out of both sides of her mouth is actually an understatement.

This week, the Supreme Court didn't just stick a thumb on the scales of justice for Donald Trump, it tossed on a cinder block instead. By delaying any decision -- for months and months -- on Trump's ludicrous claim to total immunity from everything and anything he's ever done, the court will allow Trump to win even if he loses his appeal. Because Trump's main objective in the January 6th insurrection case against him is to delay, delay, delay. The Supreme Court is aiding and abetting this scheme in rather blatant fashion.

Democrats are beginning to widen their political message in a way that could prove to be a big winner for them not just in November but for years to come. So far, the fallout from the Supreme Court overturning Roe v. Wade has been overwhelmingly positive for Democrats, since the majority of Americans actually favor abortion rights for all women. And now Democrats have the clear opportunity to link a number of other things to the proven political winner abortion rights has turned out to be. In fact, they should adopt a new slogan: "It's not just about abortion."

Because this week had a federal holiday at the start of it, Congress is off on vacation for two entire weeks. Nice work if you can get it, eh?

It's not as if they don't have anything to do, either. When they return, the Senate will hold the first impeachment trial for a sitting cabinet member ever (although "trial" may be overstating it, since it may be over before it even begins, with a simple vote to dismiss the nonsensical articles of impeachment the House finally was able to pass), the House will be under pressure to pass some sort of military aid for Ukraine before their soldiers are reduced to fighting with pointy sticks, and Congress will be staring at yet another government-shutdown deadline at the end of the week. Those are just the big things on the congressional plate, mind you. But after all their hard work (at not getting anything done on time), they all needed two weeks of relaxation, obviously.

That headline comes from the end of an aphorism that goes back to the time of the ancient Greeks: "The wheels of justice turn slowly, but they grind exceedingly fine." Today, the wheels of justice just ground out a penalty of $355 million for Donald Trump, for committing serial fraud in his New York businesses -- which we certainly found to be an "exceedingly fine" result of the case (an "exceedingly fine fine," maybe?). The $355 million can now be added to the $88 million Trump is already on the hook for, after losing two other civil cases (the defamation cases brought by E. Jean Carroll). Plus, in today's ruling, two of Trump's children were fined $4 million each, as well as a $1 million fine for another member of the Trump Organization (making it a $364 million penalty, in all). This was the capstone to a week watching the slow grind of multiple court cases Trump is currently ensnared in, so we thought it was an appropriate place to start our column this week.

In the Before-Times, back when Donald Trump was merely a minor television celebrity, anyone in politics or the media who openly espoused a theory that the Pentagon had for years been running a "psychological operation" (or "psy-op," which sounds so much cooler) to boost the fortunes of the most popular singer alive, and furthermore that because she and a star football player were now an item that the National Football League had (obviously!) conspired to advance his team to the Super Bowl (where the fix was already in for them to win) -- all so that the singer could then announce her endorsement of the sitting president -- would have been laughed off the national stage forthwith. The idea would have been considered no more than a product of the fever dreams of a conspiracy-spreading lunatic. The ravings of a nutter. Complete whackjobbery. "Tinfoil hats" would have been mentioned derisively, as America collectively guffawed at their craziness.

There is an interesting idea making the rounds in the political punditry world of late, and I have to say it is an intriguing one. Nikki Haley has a very slim chance of chalking up any wins in Republican primaries, either before or on Super Tuesday, so sooner or later she's going to have to bow to the inevitable and drop out of the GOP race. This will leave Trump as the Republican nominee, but what if this isn't the end of the campaign trail for Haley? Instead of disappearing, what would happen if Haley then ran as the No Labels candidate?

As always, we must begin with a warning for all readers. It's long. Really, really long. Horrendously long. Insanely long. It takes a lot of stamina to read all the way to the end. You have been duly warned! But because it is so long, we certainly don't want to add any more here at the start, so let's just dive in, shall we?

Welcome to the first installment of our year-end awards!

As always, we must begin with a stern warning: this is an incredibly long article. So long you likely won't make it to the end, at least not in one sitting. It is -- as always -- a marathon, not a sprint.

We have tried to credit readers' nominations where we could, but writing the whole column is such a frenzied activity that we may have omitted the citations here and there -- for which we apologize. Reader suggestions make our job putting together this list a whole lot easier, and we are indeed grateful for the people who do take the time to do so (and you still have a chance to make nominations for next week's awards, we would point out).

OK, since it is so long, let's not make it any longer and get right to it. Here are our winners for the awards categories first created on the McLaughlin Group television show, for the year that was.

President Joe Biden now has an official impeachment inquiry investigating him in the Republican-held House of Representatives. It is the most singular such inquiry in American history, since nobody -- not even the people who have been pushing the idea -- can say precisely what crime Biden has supposedly committed. So for now, they're just investigating him for the crime of (take your pick): being Joe Biden. Or being a Democratic president. Or beating Donald Trump. Or (most likely, given the Republican monomania on the idea) being Hunter Biden's father.

None of these things are actual crimes, it bears pointing out. But that simply doesn't matter to the House. They're merrily on their way to impeaching Biden for one reason and one reason alone: because Donald Trump wanted them to. Trump is still miffed (to put it mildly) that he's the only U.S. president to have been impeached not one time but twice. So, as far as he is concerned, Republicans have a duty to turn the tables and impeach the man who beat him at the polls, to try to weaken him for the presidential rematch that is shaping up for next year.

Congress has now successfully punted their budget negotiations into the next calendar year. The most astonishing part of this fact is that they managed to do so two days before the deadline, which (these days) is actually pretty impressive. We didn't go down to the wire with midnight votes, and we didn't have to see the media go through one of their "The government is about to shut down!" frenzies. So that's progress, of a sort.

There were supposed to be three big political stories this week, but in the end two of them turned out to be duds. Donald Trump testified at his New York fraud trial, but without video or audio recordings of him answering questions under oath, the impact was significantly lessened. The other Republican presidential candidates (the five who qualified, at any rate) met for their third Republican debate, but it mostly turned out to be a snoozefest.

Tuesday night, however, more than lived up to expectations. The off-year elections which were held ended up as a big night for Democrats almost across the board. Put quite simply: abortion rights won. Big time. Everywhere.

But today I thought it was worth taking a look at the other big political story of the week, since tomorrow's elections have several interesting possibilities that could reverberate beyond the borders of the states where they are held. Three states in particular are going to be impactful, no matter what the outcomes may be: Mississippi, Virginia, and Ohio.

This week in the Senate, Republicans spent five whole hours ripping into one of their own. A group of GOP senators tried to force the hand of Senator Tommy Tuberville over his petulant hold on fast-tracking all military promotions, but to no avail.

The House, meanwhile, voted for an Israel military aid bill that is going nowhere in the Senate because (among other reasons) Senate Minority Leader Mitch McConnell is diametrically opposed to the strategy.

The House also took the time to vote down a censure of a Democrat that drew Marjorie Taylor Greene's wrath, but also voted to let George Santos keep his seat. On both votes, there were significant numbers of Republicans crossing the aisle to vote with the Democrats.

Senator Tommy Tuberville has never worn a uniform (unless you count a football jersey). And yet he feels he knows the United States military better than those who are serving or have served. In particular, he feels that his blanket hold on military promotions is an acceptable political-theater tactic, no matter the impact on people's lives or on the readiness of our military. Last night, members of his own party publicly took him to task for his tantrum, but they didn't succeed in changing his mind. The next step would be for the Senate to vote to essentially ignore Tuberville's parliamentary tactic and get on with what used to be a routine and non-controversial duty of the Senate: approving high-level military promotions. But to achieve this would require 60 votes, meaning at least nine Republicans would have to vote to shut down Tuberville's obstructionism.

Mike Pence surprised everyone this weekend, when he abruptly announced he was ending his campaign for the Republican presidential nomination during a speech Pence gave in Las Vegas. The surprise wasn't that Pence's presidential ambitions were doomed -- anyone with half a brain could see that from the get-go -- but that Pence had actually realized it himself, this early in the process. Personally, I knew from the day he announced that Mike Pence was never going to win the Republican nomination -- not even if Donald Trump had suddenly decided not to run. Even without Trump in the race, Pence would still have been doomed. His flavor of Republicanism is a thing of the past, he has an incredibly bland and smarmy personality (he really deserves to have Trump hit him for being "sanctimonious," much more than Ron DeSantis), and he enraged the MAGA crowd by not following the Dear Leader's order to somehow wave a magic wand and overturn the results of the 2020 election on January 6th. Add all of that up and it equals a big defeat from the Republican voting base, plain and simple. So watching the coverage of the development on yesterday's morning political-chatfest shows wasn't any real surprise (other than the early timing of it). What was a surprise (for me, at least) this Sunday morning was to see Arnold Schwarzenegger being interviewed (for some unfathomable reason) on NBC's Meet The Press.

After three weeks of junior-high-school levels of adolescent slap-fighting, Republicans in the House of Representatives finally (!) chose a speaker. Was this largely due to fatigue at how tawdry the whole clown show was, or was it the fear that some moderate members were actually considering working with Democrats to come up with a solution? We'll never know, but we certainly are glad it's over. For now, that is. The rule on the "motion to vacate" hasn't changed, so while Speaker Mike Johnson seems to be enjoying something of a honeymoon period with even the furthest-right of his caucus, things could always go south for him, since all it would take would be five disgruntled Republicans to kick him out too. And disgruntled is what MAGA extremists do best, so we'll have to see whether this comes to pass or not in the weeks ahead.

Last night, at the Republican shrine of Saint Ronald of Reagan, seven Republican presidential candidates appeared on the same stage to debate each other. Of course, the real winner of the debate was the candidate who didn't show up: Donald Trump. Even the moderator, at the very start, had to get a little snarky about this, beginning with: "Let's meet the candidates who have qualified -- and chosen -- to be on the stage tonight...."

Not too surprisingly, the second debate shared one glaring similarity with the first: utter chaos. The networks hosting these debates have a hard choice to make -- they can either cut off (or heavily dial the volume down) the microphones of all the candidates who did not just get asked a question, or they can just succumb to the fact that Donald Trump has changed debate rules forever (by not having a shred of decorum or respect for the rules). This was made obvious once again, last night.

It's almost time for the second Republican debate, although we're still waiting to hear who exactly will be allowed on the stage Wednesday night. Just as in the first debate, frontrunner Donald Trump will not be on the stage, not through being disqualified in some way but because he has decided (once again) to stage his own event in an effort to "counterprogram" the Fox debate. Trump has a big problem with the Ronald Reagan presidential library where the debate will be held, but even without that dynamic he still likely would have skipped this one as well. He is -- quite accurately -- figuring that there isn't a whole lot of upside for him showing up, since he is already so dominant in the polling at the moment. So once again we're going to see all the candidates who have yet to truly challenge Trump's standing with Republican voters bickering among themselves.

Program Note: As I mentioned last week, I am playing hooky today. So I went looking for a column to re-run and came across this one, from almost exactly eight years ago. It's stunning in the sense of plus ça change, plus c'est la même chose, since it wouldn't take much more than changing a few names to be almost perfectly relevant today. It was written the week that John Boehner announced he was stepping down from being speaker and retiring from politics. At the time (as you'll see), Kevin McCarthy's name was being bandied about as a replacement, but ultimately Paul Ryan was chosen as a sort of sacrificial lamb instead.

Donald Trump hasn't changed. That was my big takeaway from watching his performance on this week's Meet The Press, where Kristen Welker started her new stint as host of the program by scoring a blockbuster interview with Trump. This is the first such interview he has given in a long time: on network television which is not part of the right-wing echo chamber. And it went about how you'd expect (assuming you haven't been in a coma for the past eight years). Trump flooded the zone with lies, distortions, conspiracy theories, and general blithering, and the poor benighted host simply couldn't keep up. So two big takeaways, really: Donald Trump hasn't changed, and (sadly) neither has the media.

There wasn't a whole lot of actual debate about differences in ideology... some, but not a lot. It was instead more of a series of one-on-one shouting matches between two of the candidates. More on those in a moment.

The biggest political news of the past week came from Ohio, where the voters resoundingly rejected a stealth plan by the Republicans to kill an abortion ballot measure that will appear on November's ballot. By a 57-43 margin, the voters sent a loud "No!" to the GOP, who were trying to change the rules in the middle of the game. This will have national reverberations, especially after Buckeye voters return in a few months to enshrine abortion rights in their state's constitution.

This was merely the latest in an unbroken series of victories for those fighting for women's rights at the state level. These have included ballot measures that either directly addressed abortion or stealthily sidled up to it as well as a state supreme court race in Wisconsin -- and in all of them the forced-birth side lost. Badly.

Sooner or later, America is going to have to have a rational debate over abortion. When the Supreme Court tossed out Roe v. Wade, it opened the door to any state setting pretty much any restrictions on abortion they chose to. Some of these are Draconian in nature, while others are slightly more reasonable. On the other side of the divide, blue states are enshrining the right to an abortion in their state's laws or constitution. These generally mirror the protections in Roe, with some alterations in some cases. But the real end goal for both sides is going to be a national abortion law, to finally legally codify what rights all American women actually have over their own bodies. Nothing short is going to work, since much like in the Civil Rights era some states are always going to go to the extremes -- on what is essentially a very basic human right. If the states refuse to uphold basic human rights, the federal government is going to have to step in and do so.

In the end, it wasn't even close. Yesterday, Ohio voters rejected a ballot initiative that would have taken away their own rights. In this particular case, it wasn't directly about abortion rights, instead it was the right of a majority of voters in the state to amend the state's constitution. Republicans wanted to raise the threshold from a simple majority to a supermajority of 60 percent. The voters voted "No" on the issue by a margin of 57 percent to 43 percent -- a pretty resounding 14-point rejection.

The Republican Party, as time goes by, has become less and less a fan of democracy. This is a direct result of both their policies being unpopular and their fealty to Donald Trump driving away voters who used to be in their camp. So they figure if they can't win a fair vote, they'll just change the rules.

The nation celebrated its 247th birthday this year, leaving only three more to go until the second-biggest celebration of our lifetime (as we still personally remember the ushering in the bicentennial in Washington D.C.). But since it was a short week, what with Independence Day falling on a Tuesday, we are hoping this will be a short column (for once). Well, short-ish at any rate. We are cautiously optimistic.

Cautious optimism is a good place to start, actually. We stumbled across an interesting paper from two Democratic strategists (Celinda Lake and Mike Lux) which confidently states: "All the elements are in place for a big Democratic victory in 2024," and predicts that the "trifecta" of winning the House back, holding the Senate and keeping Joe Biden in the White House is well within grasp.

One year ago, the Supreme Court overturned a right that women had been able to freely exercise for the previous half-century. Since then, the Dobbs decision overturning Roe v. Wade continues to reverberate across the political landscape. Initially it was thought by many that this would be some sort of minor and temporary political issue, as clueless pundits predicted that somehow women would just sort of forget about the fact that a freedom had been taken away from them -- that they likely wouldn't even remember it at all by the time the next election rolled around. This has been proven wrong on numerous occasions, and it will likely be proven wrong all over again in the 2024 elections as well. Losing the fundamental freedom of bodily autonomy is a lot bigger issue than many had assumed, for what are now patently obvious reasons. When has taking freedom away from people ever been popular with those affected, after all?

One year ago, Roe v. Wade was overturned by the Supreme Court's Dobbs decision, which will likely go down in history alongside Dred Scott, Korematsu, and Plessy v. Ferguson as one of the worst decisions the high court has ever made. But that's a gradual process involving a consensus of legal historians, which could take years. In the meantime, the issue has become extremely politically potent. And if the next few years is anything like the first, it is going to become a gigantic albatross around the neck of the Republican Party, since they are now held captive by their most extreme wing on this particular issue.

With twelve more days left in the month of May, the debt ceiling follies continue unabated. Speaker of the House Kevin McCarthy just "paused" the negotiations with President Joe Biden, which was a rather pessimistic note to close out what had otherwise been a rather optimistic week. There is speculation that both sides are using this "pause" merely as a political signal to their respective bases -- to show that they are negotiating hard and not giving away the store. If this is true, negotiations will likely resume at some point this weekend. But it's anyone's guess whether they'll agree even on a framework (much less actual legislative text) any time soon.
