I take your point, but in order to find for Trump on some of his claims, the SCOTUS would actually have to go against their own ruling.

Trump's main problems with his argument:

(1) Trump and his attorneys didn't seek immunity in a timely fashion and therefore waived it.

(2) Trump entering into a nondisclosure agreement with Stormy Daniels and the subsequent commission of fraud in order to cover it up in his personal business records doesn't come close to an "official act" of the presidency.

(3) Even if the conduct for which Trump is a 34-time convicted felon did constitute an "official act," the SCOTUS ruling states unequivocally: "But of course the prosecutor may point to the public record to show the fact that the President performed the official act. And the prosecutor may admit evidence of what the President allegedly demanded, received, accepted, or agreed to receive or accept in return for being influenced in the performance of the act.... What the prosecutor may not do, however, is admit testimony or private records of the President or his advisers probing the official act itself."

Trump is attempting to have his case thrown out over testimony that was related to an act that wasn't remotely "official" and a tweet wherein he himself confessed to the NDA and reimbursement on Twitter, which obviously is a public record that would be admissible even if it was an "official act."
