It just hasn't taken effect yet. Democrats aren't going to pack the Court. Neither disease nor assassination is going to intervene, nor will there be a surprise outbreak of sanity among the members of the Majority. And we certainly aren't going to elect Democratic two-thirds supermajorities in both houses of Congress.
