It's neither. It's Potter taking the stand and her lawyers not doing enough questioning to back up her defense of her freely admitted mistake. When she did freely admit her mistake, it de facto became her and the lawyers' burden to prove their defense of her admitted killing... but they didn't, and she didn't.

Russ, remember that the killing to which she freely admitted wasn't the only poor choice she made during that training. It seems to me like a jury finally holding a cop accountable for their multiple actions that caused a death. Plus the shitty lawyering in her defense.
