Now is the time to start planning for what comes next. Come January when the Dems have all three branches, they can pass what ever they want but the Repugs have the courts and you can be sure they will sue over every single piece of legislation they pass. Not to worry up you say, for eventually most of the new laws will be upheld and all that effort will be for for naught. Well, not quite, for the Dems only have a two year window to pass and IMPLEMENT laws that will make the lives of ordinary Americans better. Come the mid terms the Repugs will be complaining that the Dems can't do anything and when asked if the voters lives are better than they were under Trump, the honest answer will be NO. This will be persuasive for enough voters to turn over the Congress to the Repugs. The other big problem in implementing the new democratic programs is the enormous hollowing out of the Federal agencies by Trump, many, many worker bees have retired or quit in disgust. Biden will need to hire and train thousands. Doing this in the civil service system is a daunting task in normal times. Just the USPS and the IRS alone are short many tens of thousands of staff. I don't have any solutions to this but I sure as hell hope some very smart people are starting to think about it.

Another way to look at Dianne Feinstein's apparent kowtow might be as the final dampening of GOP senate counter-outrage.

The Democrats were expected to drag religion in all a cudjel, but never really hovered on it. That would have stoked the GOP base. I think Feinstein realised there was nothing that could be done so why give the GOP any ammo in the election...

In hindsight when this is all over, perhaps she might just get mention in the good for pissing on any fire the GOP wanted light after a contentious hearing.

Critical "talking points", that each candidate for U S Senate MUST emphasize in the next two weeks:
All of the bills that the Democratically-controlled House of Representatives have approved in the past 2 years that Sen. McConnell has pronounced DOA. Control of the U S Senate will be determined on 3 November and, should the Democrats obtain a majority, Sen McConnell will no longer be able to block legislation.
They must also highlight that we will soon have a 6-3 "originalist" majority on the Supreme Court because McConnell and the Republicans blocked President Obama's appointee from even having a hearing. Do they want the same for President Biden's nominees in 2021?

Kamala Harris was in fine form during the Senate hearings. Her "introductory remarks" are well worth highlighting, as she cautioned the American people about whats a stake.
'Republicans finally realized the ACA is too popular to repeal in Congress, so now they are trying to bypass the will of voters and have the Supreme Court do their dirty work.

That's why President Trump promised to only nominate judges who will get rid of the Affordable Care Act.

This administration, with the support of Senate Republicans, will be in front of the Supreme Court on November 10th to argue that the entire Affordable Care Act should be struck down.'

What can you say about Justice Ginsburg? She was confirmed 96 to three. Now, those were days that have since passed. I regret that. 96 to three. Now, this was a person who worked for the ACLU, someone who was known in progressive circles as an icon. Apparently, just about every Republican voted for her. Her good friend on the court, Justice Scalia, I think got 97 votes. I don’t know what happened between then and now ~Lindsey Graham this is a level of mendacity that i can't even come up with a sufficiently pointed analogy to describe, other than to call it trumpian. The smartest thing the GOP did was setting term limits on Committee Chairs. It's led to some retirements, but it's elevated the next generations.

Members of the GOP may not "look like America" in terms of many characteristics, but their party, and especially their leadership, looks a lot more like us age-wise than do Dems.

Sen. Whitehouse isn't running for president, so his approach isn't necessarily best for Biden. I assume Biden is ignoring the Court-blocking question, or rather tieing it up in rhetorical knots, because at this point he's running out the clock.
I hope he's spending his time more profitably, either nailing down a few more swing states or lawyering up for the nonsense the GOP is going to pull starting on Election Day.
